B-P-A PROHIBITED

The State Senate and Assembly o-k'd legislation yesterday
prohibiting the manufacture, distribution, and sale of
certain child products containing B-P-A...bisphenol-A. The
bill was sponsored in the Senate by Antoine Thompson.
He said it was one part of their efforts to make sure that
when parents go to the store they are not buying baby
bottles, pacifiers, or sippy cups that will harm their children.
Studies have linked BPA to early onset puberty, ovary syndrome,
and prostate cancer. Thompson said you assume the bottle
you buy off the shelf is safe, but unfortunately they leech
harmful carcinogens when they're placed in hot water. Six
other states have enacted similiar laws.

PALADINO CONTROVERSEY

Carl Paladino stirring up controversy once again. The
Republican told an audience in Watertown Wednesday
that Governor David Paterson is a drug addict. Campaign
spokesman Mike Caputo released a statement yesterday
saying Carl was referring to the governor's admitted use
of cocaine. Caputo said illegal drug use is not a small
issue and cocaine abuse is one of the most troubling
addictions. He said if the governor is no longer using
cocaine, then good for him, good for his family and
good for the State of New York....but he added that once
you're an addict, you're always an addict...and if the
Albany ruling elite is o-k with present or past drug use
among their political leaders, they need to know the
vast majority of New York is not.

OPERATION DRY WATER

The State Police and other law enforcement officials
will be patrolling the waters across the state this weekend
looking for intoxicated boaters. State Police Zone Captain
Mark Phillips says Operation Dry Water is a national
effort and it will impact all state waterways and there'll
be increased patrols. That'll include the Canal and Lakes
Erie and Ontario. He said the Coast Guard, County law
enforcement, the parks police and the DEC will be involved.
Phillips says the Coast Guard estimates that half of all
boating accidents are alcohol related. The eenforcement
effort starts today and continues thru Sunday. They'll be
looking for those who blood alcohol content exceeds .08%.

POWER OUTAGE

A NYSEG spokesman tells WLVL a large tree on Ontario
near Prospect collapsed around 5pm last night and
knocked out power for about 2 1/2 hours. Rob Lewis said
the outage affected 590 customers including those on
Niagara, Michigan, Ontario, Hawley, Trowbridge,
Oakhurst, and Caledonia Streets and Passaic Avenue.
He said the City and NYSEG worked together to remove
the tree, which he described as being rotted and decayed.

MOLS0N CANAL CONCERT SERIES

Lockport's Molson Canal Concert Series kicks off
tonight with Rusted Root at the Ulrich City Center.
Promoter Kathy Paradowski said yesterday that David
Ulrich may have cancelled his plans to allow charitable
organizations to collect donattions during the shows but
she hasn't. She said the American Legion would be
doing so tonight and she welcomed others in future weeks.
They can simply ask for donations or hold raffles, but they
must pay $100 to do so. Paradowski said they would also
be doing another season-long guitar raffle. This year's
proceeds will go to the Niagara County SPCA. The guitar
is donated by the Guitar Center and it's signed by the
different acts that appear each week.

GLDC

Lockport Mayor Mike Tucker said yesterday the
Greater Lockport Development Corporation is
continuing to review five proposals for buildings
on Canal Street. The agency discussed them during
another closed door meeting yesterday morning but
did not take any action. The three stone buildings
were acquired and renovated with more than $3-million
of state and federal aid.

BRUNO

The corruption convicton of former State Senate
Majority Leader Joe Bruno could be overturned as
a result of three US Supreme Court decisions issued
Thursday. The court placed restrictions on the use
of the so-called "honest services law," saying it cannot
be used if it's accompanied by one or two charges,
bribery or kick-back. The honest services case
against Bruno was centered on his failure to
disclose his outside business dealings but was not
specifically about a bribery or kick-back scheme, even
though Bruno's private dealings were with individuals
and companies doing business with the State. The 81
year old was sentenced in May to two years in prison,
but the judge has let him remain free while awaiting the
Supreme Court rulings. They could also have an impact
on the case against former Falls Mayor Vince Anello.
One of the charges against him involves the honest
services law.

PURSE

A 29 year old Lockport man was charged Tuesday with
snatching a purse from a 65 year old woman in the
parking lot of the Transit Road Wal Mart. Christopher
Erickson of Ruhlman Road was charged with fourth
degree grand larceny and petit larceny. Similiar
charges were levelled Thursday against the alleged
driver of his get-away car, 26 year old Lexie Quagliano
of Slayton Settlement Road in Gasport. The incident
happened around 5pm as the victim was walking to
her car. The $580 purse contained $320 in cash and
credit cards.

WYNDHAM LAWN

A juvenile at Lockport's Wyndham Lawn Home was
arersted around 8pm last night after he allegedly
attacked two male employees. A 33 year old was
punched in the face injuring his left eye. A 29 year
old was punched in the throat and kicked in the mouth
breaking his upper back tooth. The two said it
happened as they were attempting to retrain the boy
after he became argumentative and started throwing
things. The boy was charged with assault and is due
at the Town of Lockport Probation Department on
July 1.

CHANGE OF MIND

Lockport developer David Ulrich told the Union
Sun & Journal late last night he's changed his mind
and he will not allow charities to solicit funds during
the Friday night concert series. He's also scrapped
plans to operate a mini food court on Locust Street
after Mayor Mike Tucker said it would be inappropriate
to have it on city property. Tucker told WLVL he
realized it yestersay while he was in Albany on city
business. He said he called Ulrich on the way back
and explained the reasoning. Tucker said it was
because Ulrich was going to charge each restaurant
$200 and the city wasn't getting a cut as it does
with other vendors. Ulrich had told the newspaper
of his plans the day before, but he left out the fact
that the charities would have to split their proceeds
with him and Ulrich's portion would help pay for one
or two more free concerts that would've been held at the
City Center after the Molson Canal Concert Series
ends August 20. He also wanted the restaurants that
would've been in his mini food court to pay $200 a week
with the cash going to pay for extra concerts as well. Ulrich
said he would allow the restaurants that had signed up
to operate for free in his parking lot this Friday only and
that Lockport Club Hockey will also be permitted to solicit
donations , but it will be a one time thing for this Friday
only.

STATE BUDGET

The Governor talked about the State budget this
morning on New York City's WOR Radio. Paterson
saying the problem is they have been unable to replace
the revenues the state is not going to get from
putting wine in grocery stores or the sugar tax,
which he continued to defend. He said even if
people stopped using sugary products, the
state would save money on health care costs.
Paterson admitted the tax was still part of the
discussion and they're also talking about bringing
back the tax on clothing. Paterson said lawmakers
needed to come to an agreement by Monday or
he would put what he thinks is the right savings
plan in the emergency appropriations bill and
the deficit reduction would be 85 per cent cuts.
He said they would be devastating and painful and
people would scream and complain.

NIAGARA HOMECOMING

A career fair associated with this weekend's Niagara
Homecoming will be held from 1:30 till 4:30 today at
the Niagara Falls Conference Center. Chair Colleen
Kulikowski says there are 75 businesses that are hiring
and 25 support companies that'll help you write your
resume, find a job, and do things that'll increase your
skills. This years event has been expanded and
includes an awards luncheon for employers. A social
hour is also set for 4:30 till 6 at the Crowne Plaza.
The Homecoming kick off cocktail reception and
beneift will be held at 6pm Friday at the Rapids
Theatre. A $25 donation includes ten wine tasting
tickets and there'll be food prepared by the NCCC
Culinary Arts students. A cash bar will be open and
there'll be entertainment by Dennis George and the
George Scott Big Band with Melissa Kate. More
awards will be handed out, one of them going to
Carl Paladino, who will be there to accept.

EARTHQUAKE

A moderate earthquake that was centered 35 miles
north of Ottawa shook parts of Western New York
and at least eight other states at 1:41pm yesterday.
It measured 5.0 on the Richter scale and lasted
about 30 seconds. There were no reports of damage.
Some people said they felt it, others didn't. Several
buildings in Ottawa and Toronto were evacuated.

NET METERING LAW

Legislation authored by local representative Francine
del Monte that would add flexibility to the state's net
metering law passed the Assembly yesterday and is
expected to get approval this week in the Senate. Del Monte
said a farmer or a school district might be able to locate
either a windmill, or solar panels, or farm waste that can
be converted into energy off site but still within the property
they own and be able to generate the energy credits from
that particular renewable source and send it into the grid
and help reduce their costs and get energy credits. She
said it would help keep energy costs down and the
idea was presented to her by constituents who are involved
with the wind turbine business and local farmers. The
original net metering law was passed in 2008. It allows all
utility customers to receive credits for energy they
produce through renewable sources. It measures the
difference between what is produced on site and the amount
of electricity drawn from the grid. Most users cannot meet
their total demand through on site generation and continue
to receive power through their utilty company, but there
are times when on site generation exceeds energy demand
and the excess power is fed back to the electric grid providing
the entity with a credit. The bill is supported by the New York
Farm Bureau.

PATERSON SAYS FLAGS TO BE FLOWN AT HALF STAFF

The Governor has directed that flags at state government
buildings be flown at half staff Friday in honor of Marine
Corps Lance Corporal Tim Serwinowski The 21 year old
North Tonawanda resident was shot by a sniper Sunday as
he stepped out of a vehicle while on patrol in Helmand
Province in southern Afghanistan. He died of his wounds
early Monday. Serwinowski graduated from North Tonawanda
High School in 2007 and attended NCCC for a year before
enlisting in the Marines in May 2008. Paterson said he
extended condolences on behalf of all New Yorkers, that
we mourn his passing but will forever honor his service to
our country and the Marine Corps.

STOLEN MEDICATION

Deputies were called to a home on Minnick Road
around midnight today where a mother accused a
female friend of her son of stealing 21 of his Adderall
capsules. The mom said she found out about it after
her daughter got a text message from the girl who
allegedly took the medicine. Deputies went to the
girls house and interviewed her in the prescence of
her parents. She said she had gven some away and
taken some herself and none wre left. She said she
gave it to four boys and one of them told deputies
he took the pill before taking a final exam. The girl was
issued an appearance ticket at the Niagara County
Probation office in Lockport for July 15.

ONE NIAGARA

State Supreme Court Judge Ralph Boneillo said
Wednesday he would issue a ruling within 24 hours
in a dispute between the owners of One Niagara in the
Falls. One of the partners wants to compel the other
to pay at least a portion of the $1.5-million in property
taxes owed on the building. The attorney for Incredible
Investments Limited...Kevin Burke Jr...asked Boneillo
to appoint a receiver for 60 days who would keep track
of the money coming into the building and ensure the
property is not lost to foreclosure for back taxes. He
claims the building brings in $20,000 a day...a number
disputed by co-owner Frank Parlato Jr. He says the
building is not at risk for foreclosure and the non
payment of taxes is part of a strategy for dealing with
the City over a number of outstanding regulatory issues
involving the building.

ATTEMPTED BURGLARY

The Sheriff's Department called to Johnston's Family
Restaurant in Ransomville around 8am yesterday after
the owner discovered someone had tried to enter the
building overnight. Dale Johnston showed deputies
three possible points of entry. A screen window had
been moved, a storm window had marks on it, and
another screen window was damaged. He said there
is an alarm system in place but asked deputies to make
periodic checks during the overnight hours.

THOUSAND TAKES A PLEA DEAL

One of the teens accused of killing Lockport
group home leader Renea Greco last year plead
guilty to manslaughter yesterday in county court.
Eighteen year old Robert Thousand agreed to testify
against his co-defendant, 19 year old Anthony Allen.
Investigators say Allen planned the killing. The
plea deal means Thousand will receive 20 to 25
years in prison when he's sentenced October 8.
He agreed to let prosecutors use statements and a
taped interview made the day after Greco was killed
on June 8, 2009. The two teens were arrested near the
Buffalo bus station a few hours after Greco was
bludgeoned to death as they were playing cards in the
former group home on East Avenue.

CONCERT SERIES

Rusted Root returns to Lockport Friday night to
kick off another year of the Molson Canal Concert
Series in the Ulrich City Center. David Ulrich said
yesterday he will allow one charity each week into
the courtyard to solicit donations. Lockport Club
Hockey will be there Friday and the remainder of
the schedule is still being put together. Ulrich also
said seven local restaurants will be represented in
a mii food court that'll be located outside along
Locust Street. Anything bought there will have to
be consumed before you go inside and backpacks,
cooolers and lawn chairs are also prohibited inside
the courtyard.

NORTH TONAWANDA MARINE KILLED IN AFGHANISTAN

A 21 year old Marine from North Tonawanda was
killed Sunday in Afghanistan. Timothy Serwinoksi
graduated from North Tonawanda High School in
2007 and was a wide receiver on the school's football
team. The Defense Department says he was killed in
a sniper attack while serving in Helmand Province.
Serwinoski's mother is a teachers aide at Meadow
Elementary and his younger sister Emily will graduate
this Saturday. Serwinoski will be remembered during
Sunday's high school graduation at Artpark. The
district had previously planned to grant honorary
degrees to past veterans of the city and Serwinoksi
will be recalled prior to their presentation.

A-T-V'S

Four young people were charged with the theft of
five A-T-V's and a dirt bike around 3am yesterday in
Wheatfield. Sheriff Jim Voutour says their apprehension
started after a deputy saw three of them pushing a black
ATV into a driveway at 6895 Walmore Road. The department
had previously got a report that one had been stolen from a
home on Deborah Lane, not far from Walmore. He tried to
arrest them and a foot chase ensued with help from the State
Police and Lewiston Police. All four are from Erie County.
Voutour says some are from Amherst and some from Buffalo.
He says they took a bus to Niagara County and went shopping
for ATV's at several homes in Wheatfield and a bunch of them
were found stashed together. He said it's assumed that once
they had enough for all of them they planned to ride them back
to Buffalo. Three of the suspects are identified as 16 year olds
Edwin Colon of Buffalo and Michael Freers of Amherst and
17 year old Daniel Colon of Buffalo. They're all charged with
four counts of burglary, two of 3rd degree grand larceny, one
of 4th degree grand larceny, and another of petit larceny. One
juvenile was issued appearance tickets for related charges and
released to his parents. The others are in the County Jail. Two
of the victims live on Deborah Lane and two others on Walmore
Road. A dirt bike was also found in a driveway on Oakwood
Drive and the department is looking for it's owner.

WORKCAMP

About 430 high school students and adult supervisors
from the eastern U.S. will be arriving at Newfane High
School Sunday for this year's Project Reach workcamp.
The project is still based in Lockport but construction
at the high school made it necessary for them to find a
new place to stay. They'll be fixing up homes at 39 spots
in the county between next Monday and July 3. This
year's camp will be run without Jim Haid. He's got a
new job as director of PeacePrints Prison Ministries of
Buffalo. His 20 year old son Matt is working with
Project Reach headquarters in Colorado and is
here gathering supplies. The students pay $399 to
participate.

LAPTOP THROWN AT INFANT

A 27 year old Wilson man was charged around 3:30pm
Sunday with throwing a laptop computer at an infant.
William Vanderbosch of Chestnut Road was arraigned
in Town Court on charges of child endangerment and
reckless endangerment. He's due back in court Thursday.
State Police said the child was treated at ENH-Newfane for
injuries to it's forehead. Vanderbosch allegedly threw the
computer at the infant after a verbal dispute escalated.

FIRE COMPANY PRESIDENT

The President of Niagara Active Hose appeared
briefly in Wheatfield Town Court last night for a
pre-trial hearing in connection with his recent
DWI arrest. Justice John Mattio scheduled another
court date for next month for 30 year old Robert
Jasper Jr of Saint Joseph Road. He was arrested June
6 when he allegedly struck another vehicle at Niagara
Falls Boulevard and Sy Road while he was operating an
SUV owned by the fire company. He registered a
blood alcohol content of .11. Jasper is still the
president of the fire company but he's been taken off
active duty and no longer has access to the fire
company vehicle.

FALLS MAN GETS 18 1/2 YEARS IN PRISON

A 33 year old Falls man was sentenced to 18 1/2 years
in prison Tuesday for possessing half a pound of
powdered cocaine and another pound of crack cocaine.
Dwandell Williams was arrested in April 2009 and was
found guilty earlier this year. Assistant US Attorney
Mary Clare Kane said federal authorities found the
drugs and digital scales during a search of his home and
car. He was arrested six months after being released
from a federal prison for a cocaine possession conviction.

AMUSEMENT PARK

The site of the former tethered helium balloon launch
in the Falls is being transformed into a small amusement
park. Midway of Niagara says a ferris wheel and other
rides will be opening by July 1. They'll operate seven days
a week through the end of October at 310 Rainbow Boulevard.

CIGARETTE TAXES

State Senator George Maziarz voted no Monday
but lawmakers in Albany approved the bill that'll
keep the state government running while imposing
an additional $1.60 per pack tax on cigarettes. The
bill also includes a provision to begin collecting
taxes on cigarettes sold to non-Indians at reservation
stores. In casting his no vote, Maziarz told the
Senate that a delegation from the Senecas had left
Albany recently with the understanding that an
agreement had been reached on the issue and that
they would feel like they were once again lied to by
representatives of the state. Maziarz predicted
there would be a "clash of cultures" September
first if the Governor really really plans to collect
the tax on Indian reservations. He said it would
probably take place on the Southern Tier and he
suspected..and hoped he was wrong....that there
may be violence and there will be people who will
get hurt. He said the reason it would happen would
be because of the vote that took place in Albany
yesterday. The bill also contains increases in
taxes on cigars, snuff, chewing tobacco, and pipe
tonacco based on their weight or wholesale prices.
Little cigars will be taxed as cigarettes. Seneca
President Barry Synder said the bill was nothing less
than a deliberate effort to sabotage their federal
treaty rights and rape their economy to bail out the
state. He said the governor and the legislature should
be ashamed of themselves for looting their economy
because they've squandered theirs through overspending
and poor management. He said 3,000 Seneca and non
Indian employees of Seneca owned businesses could lose
their jobs if the tax is collected.

ENERGIZE NEW YORK

The State Senate Monday passed the Governor's bill
to replace the Power For Jobs program with a new
910 megawatt program called Energize New York.
It would offer low cost power to businesses and
institutions in up to seven year contracts in exchange
for job commitments and capitol investment. Paterson
thanked Senators Maziarz and Aubertine for their
work in developing the legislation. He called on the
Assembly to pass the bill before the end of the session.

FALLS COUPLE PLEADS NOT GUILTY IN DEATH OF THEIR DAUGHTER

A Falls couple plead not guilty in County Court
yesterday to murder charges in the death of their
two year old daughter. Randy and Nicole Colucci
of 22nd Street allegedly kept their two children
caged in a 3by2 foot playpen covered by a mattress
for 17 hours March 30 &31 while they slept and the
girl was injured when she tried to crawl out. Carmen
Colluci was taken to Women & Childrens Hospital
where she was on life support till she died April 8.
An 11 month old boy who was in the playpen with her
survived. Prosecutors said the two children were
put in the playpen at 7pm and were left unattended
until noon the next day. They said a TV set had been
placed on top of the mattress that covered the
playpen. The couples three other children were
also sleeping in the home. The two parents were
indicted by a County Grand Jury last Thursday.
Judge Sara Sheldon Sperrezza set bail for 25
year old Randy Colluci...and 24 year old Nicole
Colluci at $75,000 each.

DESALES GRADUATION

DeSales will hold a graduation Mass Thursday night
for the 42 members of the class of 2010. It'll start at 7
at Saint John the Baptist Church. A member of the
class of 2002 will be the guest speaker. Breanne
Nicholson went on to graduate from Mt Saint Mary's
Academy and LeMoye College. She's working on getting
a master's in school counseling at Niagara University.
Her sister, Larissa, is one of this year's grads. Jillian
LaRose is the class valedictorian. She'll attend Lockport
High School in September.

LOCKPORT BOY

Lockport police are investigating after a three year
old boy was taken to Women & Childrens Hospital
last week with breathing problems. Detective Captain
Richard Podgers said police were called to a High Street
apartment around 11am last Thursday. They found a young
man carrying the boy wrapped in a blanket in a common
hallway. The County's Child Protective Services told police
the child's condition may not be from natural causes.

DONATIONS

The Lewiston Village Board last night told the Lewiston
Volunteer Fire Department they are not permitted to
collect donattions on the streets on Tuesday. The Board
said they only want one group to collect on concert nights
and permission was already given to the Community Missions
of Niagara Falls. Lewiston #1 President Les Myers told
lawmakers he was under the impression they had already
been given approval for their "Fill The Boot" collection.
They're trying to raise $150,000 for a new ambulance.
Community Missions said they only collected $73 last week
because people said they had already given. Tonight's show
features former Fabulous Thunderbirds member Jimmie
Vaughan and his Tilt A Whirl band. Blues Remedy will open
at 6:30.

SUNDAY MORNING FIRE

The family of a seven year old Lockport girl says
she saved her sister, her mother, and the family dog
after a fire broke out around 4:30 Sunday morning in
their apartment building at 177 Genesee. Gracie Hubler's
family lived on the second floor and she heard a fire
alarm go off in the apartment directly below theirs. It
was occupied by her aunt, her fiancee, and a daughter.
The aunt told the Union Sun & Journal she called 911
after an electrical problem in her kitchen sparked the
blaze. It spread to the dining room and there was a lot
of smoke. She told the paper they lost everything and
nothing was salvagable. The newspaper says the police
department would not give them any information about
the blaze and several calls to the fire department seeking
details were not returned. WLVL has experienced
similiar problems since the dispatch was transferred to
the police department.

ZSEBHAZY

An 18 year old Lockport woman was ordered held
on $50,000 bail Monday in County Court in
connection with the January 19 break-in at her
stepdad's house in Royalton. Judge Sara Sheldon
Sperrezza said Jenna Zsebhazy was a "grave flight
risk." The woman had jumped bail and fled to
Texas after the incident. She and Anibel Cordero
allegedly stole a .357 Magnum on the 19th. They
allegedly tried to burglarize the home again two
days later but the stepdad, 63 year old Dennis
Cherry was waiting for them and fired 15 rounds at
their vehicle. He was originally charged with
reckless endangerment by the State Police, but
plead guilty to a misdemeanor and expects to
have the charges against him dismissed when he's
sentenced in August. Court officials say Zsebhazy
also faces unrelated drug charges.

BLACK BEAR

People in Newfane are talking after several residents
reported seeing a black bear Saturday morning near
East Avenue and Transit Road. A Sheriff's depputy saw
the animal as well. Everybody said the bear did not
display any angressive behavior and was last seen going
into a wooded area. The Sheriff's department is advising
residents to watch what they do with their garbage. Store
it in clean secure containers and keep it inside until
it's scheduled for pick-up. Clean your barbecue grill
after using it and bring it inside if possible. Feed your
pets indoors and turn off kitchen exhaust fans that vent
to the outside whenever possible. Do not add meat scraps,
bones or melon rinds to your compost pile.

MORE THAN ME

A bon voyage party will be held tonight at the Hard
Rock Cafe in the Falls for the band that won the right

to open for Paul McCartney at his upcoming Sunday
concert in London. MORE THAN ME will perform
during the party which runs from 5:30 till 7:30. It's
open to all ages and there is no cover charge. We're
told the eatery will be serving traditional English
dishes, a speciality tea beverage, and there'll be
British costumed actors and decor.

NIGHT IN

Residents in the Falls will have another chance to talk
to the Mayor Wednesday night. Paul Dyster will have
another of his "Mayor's Nights In" at City Hall from 5 till
7. You don't have to make a reservation, just sign in and
wait your turn. Dyster says he will make every effort to
accomodate everyone that shows up.

BAKERY FIRE

A fire in the Falls around 5:20pm Saturday totally
destoryed a Buffalo Avenue business. Damage to
Lauranda's Bakery was estimate dat $100,000. Battalion
Chief Patrick Martin said the wood frame building also
had apartments on the first and second floors and it's
occupants are being helped by the Red Cross. The cause
has not yet been determined. The blaze required the use
of all on duty firefighters and mutual aid was requested
from the County to cover the City.
