CROP WALK

THE 27th annual "Crop Walk" will start at 2pm Sunday in
Lockport. Chairman Steve Hall says it's designed to combat
world hunger and 25% of what they raise will help out three
local organizations...Lockport Meals on Wheels, My Brothers
Keeper Outreach Ministry, and the nutrition arm of the Migrant
Ministry based at the First Baptist Church In Newfane. The six
mile trek starts and ends at the Second Presbyterian Church.
They'll walk to the Canal Road...or Harrington Road Bridge as
it's called by some....and back. Registration starts at 1pm.
They raised over $15,000 last year.

UPPER MOUNTAIN FIRE COMPANY

The Upper Mountain Road Volunteer Fire Department will
wrap up "Fire Prevention Week" tomorrow with an open
house and a christening of a new piece of equipment. It's
a refurbished 2002 E-One Hurricane and it's 105 foot ladder
will make it the tallest in the area. It was purchased because
the department's former truck needed $75,000 worth of
repairs. You can take a look at the replacement from
11 till 3 Saturday. They'll also offer fire truck rides,
tours of the hall, blood pressure checks, car seat
inspections and fire prevention and safety information.
The hall is at 389 Moyer Road. Food and drinks will also
be available.

SCHOOL BUS ACCIDENT

Nine students from the Niagara Academy were not hurt yesterday
after a car turned into the path of their schoolbus just after 3pm
at the intersection of Gasport and Rochester Raods. The BOCES
students were checked by staff from Medina High School and
released to their homes. 36 year old Gail Urtel of West High Street
in Lockport was charged with failing to yield the right of way.

KRYZAN-LEE DEBATE

Republican Chris Lee and Democrat Alice Kryzan fielded
questions last night in a low key debate on public television.
Both said they would have voted for the $700-billion bailout
of Wall Street and they both called for more oversight of the
institutions. They took the expected party line on universal
health care. Kryzan was for it and Lee against. Kryzan also
opposed extending the current stimulus bill that provides
tax breaks for businesses and individuals earning more than
$250,000 a year. Lee said raising taxes would kill jobs. He
also advocated for increased offshore drilling. The two are
competing for the House seat being vacated by Tom Reynolds.
Lee's 44 and has a background in business. In his opening
statement he emphasized he's not a career politician and said
he wants to use his business background in government.
Kryzan is 60. She said she wanted to bring people together to
get things done.

SIX MILLION DOLLAR DEFICIT

Falls School Chief Carmen Granto told the school board last night
the district is facing a $6-million deficit in this year's budget. He said
the shortfall developed because the spending plan contained revenues
due from failed businesses that owed the district money under "payment
in lieu of taxes" agreements. Granto said they would use what they
thought was to be a $3.8-million surplus...and another $1-million in
general funds to make up some of the difference and that he'd be
back next month with reccomendations on what else they could do
to get the rest. Board members were also given folders containing
the corrective action plan to deal with all the problems found in the
state comptrollers audit. They'll study it and make changes before
sending it off to Albany....which they must do by January 7.

A BIG GIFT

Sabres owner Tom Golisano presented Niagara University
with a $10-million gift Wednesday that'll be used to help
build a new science building that'll carry his name. The
gift is the largest in the school's history and will be
applied toward their $80-million "Promise of Niagara"
campaign. The gift will be spread out over 5 years time
and Golisano gave the school $2-million yesterday, University
President Father Joseph Levesque said they still need
to raise $16.5-million to build the new science center.
It'll be a 2 story, 44,000 square foot facility. They hope to
finish it by the Fall of 2011.

GLENDALE DRIVE STABBING

Three men from the Town of Lockport were arraigned
Wednesday in County Court in connection with an
August 12 stabbing on Glendale Drive. 29 year old
Jose Molina-Roman is charged with attempted murder
and several assault charges....including attempted
gang assault. Co-defendants 22 year old Axel
Antongiorgi and 23 year old Delman Molina-Roman
were arraigned on the same assault charges. The
three live on Sweetwood Drive and are alleged to
have attacked Luis Orona around 10:30pm in front
of his apartment. He told deputies the three jumped
him as he was returning from the store with a six pack.
He suffered a puncture wound to the back of his
neck and another to his chest. a pre-trial conference
will be held November 12 and the trial could start March 9.
Judge Matt Murphy set bail at $25,000 for Jose Miolina-Roman,
$12,000 for his brother, and $15,000 for Antongiorgi.

PURDY ROAD

A Vizio 32-inch flat screen TV was stolen from a home at
4317 Purdy Road in the Town of Lockport during the day
Wednesday. The victim says the $800 set was taken
sometime between 8am and 2pm. Entry was apparently made
by moving an air conditioner in a front family room wndow.
Neighbors say a black pick-up has been seen in the area
recently.

WATER, WATER EVERYWHERE

A Wheatfield family returned home yesterday to find their
basement flooded. Vandals had removed the filter cap
on their in-ground pool and manually turned on the pump...
which released about 40,000 gallons of water next to the
home at 3229 Woodland Court. The sump pump couldn't
handle the enormous amount of water and the basement
floor suffred $1,000 damage.

BOYERS TAVERN

Burglars entered Boyers Tavern in Gasport sometime between
3:30 am and 12:30 pm Wednesday. The owner says the cash
register was tampered with, a juke box was damaged, and it
appears they tried to pry open a game machine on the bar.
The juke box suffered about $200 damage but it's not known if
any money was taken. Entry was made through a rear door.

BEEBEE ROAD BREAK-IN

A Wilson couple telling Sheriff's deputies someone threw a
rock through their bathroom window between 6:30 & 9am
Wednesday and entered their jome at 3166 Beebee Road. A
small Sentry fire safe was taken containing a passport,
social security card, birth certificate, their vehicle title, the
deed to their home, and their last will and testament. The rock
also smashed the toilet tank and a couple of dressers and a
desk had been rifled through. The damage and missing items
coming to over $600 in losses.

LOCKPORT COUNCIL MEETING

Lockport lawmakers last night o-k'd a plan to install three surveillance
cameras near the VanDerMark and Twin Lake Chemical plants on
Mill Street. They'll cost about $50,000 and be paid for with a
Homeland Security grant. There will be monitors at police
headquarters where they will be able to pan and zoom them if
they suspect criminal activity. They will also be able to detect
gas releases from the facilities. The city will be accepting bids
and they hope to install them by the first of the year. More
cameras could be added at other locations in the future.
The Council also adopted a $22.6-million 2009 budget. It
reduces the tax rate by 2 cents per $1,000 valuation. They
approved a local hiring policy suggested by the Niagara
Organizing Alliance For Hope. Companies winning city
contracts worth more than $50,000 are requested to try
to hire 30% of their workers from within the County. The
same rules apply for developers receiving help from the
City on projects worth more than $250,000.

MEDINA MEMORIAL

Medina Memorial Hospital was locked down for about four
hours Tuesday after an Albion woman said she got a rash and
displayed other symptoms after she opened her phone bill.
The woman showed up at the Emergency Room about 2pm.
Postal officials determined there was nothing harmful in the
envelope close to 6pm, but before that happened 40 people
who came in contact with the woman were decontaminated
and officials restricted people from entering or leaving the
hospital.

NEWFANE EARLY CHILDHOOD CENTER

Officials at Newfane saying last night repairs to the Early Childhood
Center are going well and everything should be back to normal by
October 20. Assistant principal Sharon Smith said six classrooms
have been cleaned and nine others and the cafeteria still need
attention. The kitchen did not need any renovation work and the
children have beeen eating in an atrium in a seperate wing of the
building. The school district closed the building September 30 after
paint chips were found to be falling from the ceiling. None of them
tested positive for lead but another taken from a beam in the ceiling
did. The repairs are being made by Epic Contracting. The School
Board also voted to accept a $100,000 grant from Assemblywoman
Francine Del Monte. The cash will be used for a variety of things
such as art and music supplies, athletics, painting, and technology
upgrades.

CITY OF LOCKPORT BUDGET

Lockport residents will see a small tax cut under the 2009
budget expected to pass tonight. The spending plan calls
for a two cent reduction from the current rate. It'll be
$15.66 per thousand dollars valuation. That'll save the owner
of a$100,000 home two dollars. The city managed to lower the
rate by applying surplus money and $750,000 in state aid to
the budget. The spending plan adds a new position of
Deputy Corporation Counsel who'll be dedicated to
housing court violations. It will pay $18,000 a year. Only
three people showed up at last night's public hearing.

COUNTY LEGISLATURE

Ousted Niagara Falls City Court Judge Robert Restaino has a new job! The
county legislature last night appointed him as the county's Special Assistant
for Medicaid Provider Fraud. His nearly $75,000 a year salary will be paid for
with a state grant. His job is to find fraudulent claims submitted to Medicaid
by doctors and other health care providers. The county gets to keep 25%
of whatever is recovered. Restaino's a Democrat and the brother of Social
Services Commissioner Anthony Restaino. The legislature also appointed
Republican Russell Jackamn II to replace former coronor James Joyce for
the remainder of the year. All the representatives from the Falls voted
against the move. Lawmakers also scheduled a public hearing for October
21 on a proposal to set the pay for all four county coronors at $17,500 a
year effective in January. That would be a pay cut for some and an increase
for others. The legislature turned down a plan to borrow $6.7-million
for ten projects and equipment purchases. Thirteen votes were needed to
pass it and it failed 12-6. Democrat Dennis Virtuoso said the borrowing
should be put off until the economy settles down.

NIAGARA FALLS SCHOOL DISTRICT AUDIT

The Niagara Falls School District overpaid 272 employees more than
$500,000 and inappropriately paid Superintendent Carmen Granto a
lump sum of $10,800 according to an audit released Tuesday by State
Comptroller Tom DiNapoli. It covered the period between July 2005
and last December. The lump sum payment to Granto was for unused
vacation time but auditors said Granto never recorded when he went on
vacation for 12 years and the District paid him as if he took none though
he did make several trips to Florida. His contract was also changed so
he could receive lump sum payments for unused sick days. He's
gotten two checks totalling over $147,000 since 2006 and another is due
in 2008. They also charged that Granto used his district credit card to
pay for $2,200 in travel expenses related to his consulting work. The audit
also found the district paid $543,000 to 12 people as independent contractors
when they should have treated and compensated as employees. The District
also incorrectly classified it's assistant attorney as an employee when she
was actually an independent contractor. Auditors found eight other
instances where proper procedures were not followed with the use of
credit cards, leave time, and other financial moves. The audit contained
33 reccomendations for officials. School Board President Bob Kazeangin
said Granto has already repaid the money and they have addressed most of
the reccomendations. He said they disagreed with DiNapoli's findings
on the 12 people who were paid as independent contractors and showed
they were correct to do so. The 66 page report will be reviewed by the US
Attorney with the appropriate law enforecement officials.

JOE ANDERSON'S WINTER ATTRACTION

Developer Joseph Anderson is planning on opening
a snow tubing ramp and ice rink on three acres of vacant
property he owns in downtown Niagara Falls. It'll be
East of the Days Inn and will be built by a New Jersey
company called "Snowmagic." It's expected to be open
from mid December thru March. It's president says they'll
create a 300 foot snow ramp with 8 lanes that can handle
sledding, skiing, snowboarding, and other activities. Anderson
says he wants to establish a winter like carnival downtown
and depending on how the initial phase goes, he hopes to
add to the development and it could become a year round
attraction. It'll be just North of Niagara Street between Third
and Rainbow Boulevard.

WAL MART

An attorney for Lockport Smart Growth says he'll meet a court
imposed deadline to file an appeal of the Town of Lockport's
Planning and Zoning Board's ruling that Wal Mart can build their
Supercenter where the Lockport Mall sits. The Appelate Division of
State Supreme Court says the appeal must be filed by November 21.
That news came to light during a work session yesterday by Town
lawmakers.

STARPOINT

Starpoint school chief Doug Whelan saying last night the
School Board will consider letting home schooled kids
take part in the district's intramural sports and extracurricular
programs. His remarks followed a public hearing where ten
parents spoke in favor of the idea. One said it would not have
a big impact on the district budget noting home schooled kids
can participate in the Grand Island school district and that only
six or seven of the 67 eligable did so. Starpoint has 47 home
schoolers. Board members Anne Marie Reeb and Linda
Biernat said they would have to study the matter and set up
policies before the program could be enacted.

YES YOU ARE SUSPENDED!

A 16 year old Wilson High School student was arrested for
trespassing yesterday after he came to school after being
suspended. Principal Dan Johnson told Sheriff's deputies
Joshua Christian was suspended last week due to behavorial
problems. He said Christian was told he was not allowed on
school grounds until other arrangements were made for his
education. He said Christian has been back several times and
when confronted said he would not leave and he was going to
have to be arrested. His grandmother told deputies Christian
was "out of control" and would not obey her orders. Christian told
deputies he did not care and he was not going to leave because he
felt he was not suspended and they'd have to arrest him. He's now
being held on $100 bail in the County Jail. He's due in town court
October 14 at 7pm.

DEPUTY CLEARED

A Niagara County sheriff's deputy has been cleared of any
criminal wrongdoing for shooting a man to death during a
drug sweep in Buffalo in July. Deputy Aaron Schultz killed
43 year old Marvin Sullivan who was with a woman targeted
in the sweep. Schultz's attorney....Thomas Burton...says Erie
County DA Frank Clark determined the facts are clear enough and
a grand jury will not review the case. Burton said his client fired
three shots at Sullivan when Sullivan pointed a shotgun at the
deputy as he entered an upstairs bedroom on Kay Street in Buffalo.

THREE VEHICLE ACCIDENT IN THE FALLS

Two people involved in a three vehicle alcohol related
accident around 11:30 last night on the Highland Avenue
Bridge are said to be in fair condition today at ECMC. Thirty
year old Blasina Matthews's 2000 Chevy was struck by two
different vehicles. Her 4 year old son was in the car at the
time and he was treated for a shoulder injury and released
from Women and Childrens Hospital. Thomas Altman of
McKoon Avenue was driving the '97 Olds that struck her
Chevy head on. He's also in fair condition. Police say
Matthews ..whose 30 years old and lives on 9th Streert...
was going North on the bridge when Altman hit her
vehicle. Her car was then struck for a second time by a
2003 Ford SUV operated by 46 year old Arnold Walker
of 18th Street. He was not hurt but both he and Altman
were charged with DWI and reckless driving. Walker
was also charged with drinking while behind the wheel
and having an unregistered vehicle. Altman is
additionally charged with driving left of center and unsafe
passing. Matthews was not charged with anything.

YOU WANT FRIES WITH THAT?

A fire that started in an unattended deep fryer did about
$10,000 damage Saturday to a home at 3776 Lockport Olcott
Road. David Leathers told Sheriff's deputies he was warming
up the unit on his front porch around 1pm when he left with his
two teenage sons to get some french fries. The porch was
enveloped in heavy smoke and flames when they got back.
His wife Brenda had been sleeping in the back of the house.
She was awakened by neighbors and got out safely.

GRAND ISLAND BRIDGES

A 2 year project to rebuild the concrete underpinnings of the
South Grand Island bridges will start soon. The $48-million job
also calls for the replacement of the bearings supporting the
steel trusses. Workers will be putting up the platforms this Fall
and the repairs will start in the Spring. The surface of the Northbound
bridge will be replaced in 2010. It'll be the first time it's been replaced
since the span was built in 1962. The work will be done entirely
at night so all lanes can stay open during the day and on weekends.
The American Bridge Company of Pittsburgh is slated to finish the
project by November 2010. The North Grand Island Bridges are
slated for an overhaul sometime after 2011.

HONOR FLIGHT

State Senator George Maziarz is co-sponsoring another
trip to Washington Wednesday so local World War II vets can
visit the memorial honoring their service. The World War II
Memorial opened in 2004 and Maziarz says the sad truth is
that most of the 16 million men and women who served during
that era will never get to see it. Over 30 vets will be on board when
the flight leaves the Buffalo airport Wednesday morning. Maziarz
was on board the first "Honor Flight" this past June. He says it
was one of the most memorable and rewarding days in his career
in public service.

TIME WARNER

Time Warner customers in Western New York are not the only
ones who are having to do without a local TV station on their
cable line-up. LIN-TV....which owns channels 4 &23 is also trying
to extort money from the cable operators customers in 11 other
cities including Indianapolis and Green Bay, Wisconsin. LIN claims
they deserve compenstation similiar to that paid by subscribers
to satellite TV. Time Warner customers should know that many
shows carried on channel 4 can be seen on cable channel 15 from
Toronto. They carried Oprah at 4pm, all three of the C-S-I shows,
Criminal Minds, The Amazing Race and Ghost Whisperer. Check
your listings for days and times.

FROST ADVISORY

The National Weather Service has issued a frost advisory from
midnight tonight thru 8am Tuesday. Forecaster Dave Sage expects
the temperature will drop to about 37 degrees by midnight. We're
still a couple of weeks away from the average time for the first
freeze. It generally comesin mid to late October.

D-W-I

A 49 year old Lockport man allegedly blew a .21 around 9:30
last night after he was arrested for DWI on Prospect Street.
Police say that James Felvus Junior of 200 Clinton Street
was unable to follow directions when they tried to administer
field sobriety tests. An open bottle of Bud was found on the
center console. His vehicle and his dog were picked up by
family members. Felvus was also wanted by the Sheriff's
Department on two active warrants and he was released to their
custody.

BROTHER ATTACKED

A Lockport man was taken to L-M-H Sunday after his brother
allegedly attacked him in a dispute over a vehicle. Police say
49 year old Lonnie Pierce of 100 Caledonia went to his brother's
home on East Avenue around 9:30 am and attacked him in the
driveway. Pierce used his brother's cane to beat him on the
back and police reports said he jumped on him and choked him.
The victim tried to escape into his garage but Pierce forced open
the door doing $50 damage. Pierce was arrested later at his home.
His brother wants an order of protection.
