A federal grand jury in Buffalo Thursday returned
a six count indictment against three County men
claiming they used two Wheatfield restaurants for
drug trafficking. J-T Wheatfield co-owner, 45 year
old Joseph Tomasino of North Tonawanda, Papa
Joe's Bar and Restaurant owner, 41 year old Stephen
Catone of Wheatfield, and 28 year old Wesley Albert
of North Tonawanda were charged with conspiracy
to distribute five or more kilograms of cocaine in
addition to the crime of maintaining drug involved
premises. The indictment seeks the forefeiture of
the two restaurants. The charges carry a maximum
penalty of life in prison, A $4-million fine, or both.
The Grand Jury also charged Albert with growing
marijuana at properties in Niagara and Erie counties.
The charge carries a maximum penalty of 20 years
in prison, a million dollar fine, or both. Assistant US
Attorney Michael McCabe said the indictment charges
the defendants were involved in a large scale drug
trafficking organization in parts of Niagara and
Northern Erie counties that started in 2005. The
indictment charges Albert with supplying cocaine
to Catone who then allegedly stored and sold it
at his business. Tomasino is accused of buying
cocaine from the drug ring and then allowing
distributors to sell it from his bar in 2009. The
charges stem from a drug raid last July where
twenty others were also arrested.

PASQUANTONIO RESIGNS
The Niagara Falls School Board last night accepted
the resignation of former CSEA Union President
Jeffrey Pasquantonio during a special meeting. It
happened after a resident submitted evidence he was
doing personal business while he was supposedly
clocked in for the district. Pasquantonio was
followed by Probe Services for three years and was
allegedly seen painting and doing construction work
at private homes between 50 & 60 times. A confidential
report said he used a district issued credit card to buy
paint and materials. He was also videotaped shopping,
running errands, and dining out in Niagara and Erie
counties during work days. District officials say he
won't face disciplinary action but criminal charges
could be filed.

GOVERNOR'S BUDGET ADDRESS
The Governor's office announcing he will
propose a four year moratorium on unfunded
mandates in his budget address next Tuesday.
He'll also propose reforms to the Wicks Law to
lift contract restrictions that increase costs for
school districts and ultimately, property taxpayers.
Paterson said the law imposes inefficient
contract requirements that substantially drive
up capitol construction costs. Paterson's office
says his mandate reform agenda includes more
than 100 reform initiatives that'll provide savings
to local governments of nearly a billion dollars
over the next three years.

TERM LIMITS
Lockport alderman Andrew Chapman proposed last
night the city should put term limits into place for
elected officials. Corporation Counsel John Ottaviano
said they could do it without holding a referendum but
they would have to hold a public hearing. The resolution
to do so was seconded by second ward alderman Jack
Smith. He said he's against the idea, but he did so just
to hold the hearing. Chapman said incumbents have an
unfair advantage. He proposed limiting future mayors
to two four year terms and future alderman to three
two year terms. Lawmakers could run again for their
old jobs after taking a term off. An alderman who had to
leave office because of the law could still run for mayor.
Mayor Mike Tucker said there are already term limits and
they're called elections. The Council is also expected
next week to o-k a three year extension of the city's
contract for the Molson Canal Concert Series. The
original deal with promoter Kathy Paradowski runs out
this year. The extension through 2013 would guarantee
at least nine shows a year.

A GALA OPENING FOR THE GIACOMO
A gala opening was held last night in the Falls
for Carl Paladino's Giacomo Hotel at 222 First
Street. He called it a watershed moment for the
city. He said it was a long time in coming and
it was nice to see the building lit up again, that
it hasn't been like that in years and years and years.
The 21 story structure was formerly known as the
United Office Building. James Oliver is the hotel
manager. He said the project started about seven
years ago when the building was filled with five
feet of water and had been abandoned. Oliver
said Paladino saw the vision for the art deco
hotel. The building was erected in 1929 and
is now on the national historic registry. Paladino
sunk $10-million into the property. It includes
a 38 room boutique hotel, office space, and
24 residences. The hotel is named after one
of Paladino's uncles. The top two floors have
exterior lighting to enhance the city's skyline.

LEE SIGNS ON
Congressman Chris Lee signed onto legilsation
Wednesday calling for health care discussions to
be open and available for public viewing. He said he
shared the frustration Western New Yorkers have
with the way Washington operates...and the type
of back door deal making that's been going on
is cause for additional concern. He signed a petition
that would force a House vote on a bi-partisan
resolution that says any conference committee or
meeting held to determine the content of the bill
should be done in public in front of the American
people.

PAYBACK
The governor announced this morning the
State will have enough money tomorrow
to complete all the payments to school
districts and local governments that were
supposed to get money from the State in
December. Paterson said it would be the end
of this chapter but not the end of the problem.
He said the State has $13-billion that needs
to be paid in March and if the Legislature
does not close the budget deficit they would
be right back where they were.

ETHICS REFORM
Democratic and Republican leaders in Albany
yesterday announced the introduction of sweeping
ethics and election law reform. The legislation will
include provisions agreed to by both the Senate and
Assembly. It would require greater disclosure from
lobbyists and restore an independent lobbying
commission. Other provisions call for more
information about the outside sources of income
by lawmakers and it calls for the State Board of
Elections to enforce greater adherence to campaign
finance laws.

FUTURE DEVELOPMENT SPOTS FOR HI TECH
The Majority Leader of the County Legislature
said last night National Grid would be sending
up to $300,000 to the county to pay for studies
of two sites on Lockport Road. Rick Updegrove
said they believe the spots are suitable for the
construction of data centers. One of them is
a 71 acre site at Lockport and Comstock Roads
in Cambria. The other is a 142 acre location on
Lockport Road between Bear Ridge Road and
Campbell Boulevard in Pendleton. The announcement
was made at last night's meeting of the legislature's
Administration Committee. A joint news release
by the county and National Grid said the utility
would also provide matching funds to Cambria
and Pendleton for water and sewer improvements.
Updegrove said the studies would put the County
at the top of the list for site selections.

NIGRO
The County dropped charges against a 23 year
old Lockport woman Tuesday in connection with
the morphine overdose death of her daughter
in 2008. Prosecutors thought they had a weak
case against Sara Nigro. Her live-in boyfriend,
24 year old Nicholas Doxey of Niagara Street, was
allowed to plead guilty to a misdemeanor charge
of child endangerment. He could be sentenced to
a year in jail on March 23. Doxey told Judge Matt
Murphy he did not know how their 13 month old
daughter, Sierra Marie Doxey, got the morphine
into her system. His attorney, Earl Key, speculated
a pill might have been dropped into the girl's
gifts by guests as a birthday party two days before
she died.

last month because of it's condition. He said the
Peace Bridge's state assigned safety rating was

STATE OF UPSTATE
Governor Paterson did not offer much new in
yesterday's State of the Upstate address. About
200 people listened at the Buffalo Museum of
Science as he re-emphasized issues brought up
in his State of the State address last week. He
started by talking about ethics reform and
criticized the Legislature's failure to respond to
the State's economic problems. He mentioned the
proposed spending cap, property tax relief, a
new econominc development effort, and a special
program to sustain housing in blighted cities like
Buffalo. Paterson strongly endorsed the state's
application for federal funds under the Race To The
Top program. He only specifically mentioned Upstate
during the end of the speech , saying again he
wanted to expand the Erie Canal development
corridor all the way to Syracuse and to make
Upstate the "back office" for corporations
with headquarters downstate. He said there was
still time to "save" the Empire State. Falls mayor
Paul Dyster called the speech "stark and austere."
He said Paterson let the people know difficult
choices are necessary for the state to move
forward.

GOVERNOR'S SON IN TROUBLE
The Governor's 15 year old son was taken into
police custody yesterday in New York City
for allegedly possessing a stolen credit card. Police
believe it was lost or stolen and they say he
may have used it. The card was found after police
took Alex Paterson into custody for playing dice
in the street. He and another boy were given juvenile
reports for loitering and released. They will not have
to appear in court and they were not criminally
charged. Paterson asked that their privacy be
respected during this personal time.

FLU SHOT CLINIC
The County Health Department will offer free flu
shots Thursday at the Gratwick Fire Company at
110 Ward Road in North Tonawanda. It'll run
from 10am till 10pm and and it's open to any
County resident. both the H1N1 and seasonal
flu shots will be available for anyone over six
months of age. The department is also offering
free cancer screenings for those between the ages
of 40 & 64. We're told a change in state policy
last April eliminated the eligibility of those between
the ages of 18 & 39 from the program, and as a result
the county has a huge surplus in funding that must
be used by the end of March or they will lose it.
What's more, the State might give them less cash
next year. The program is overseen by the health
department but the screenings are done by hospitals,
health care clinics, and physicians. Follow up services
are also available. The screenings are for those that
are not insured or under-insured. Call 278-8285 for
information.

The County I-D-A is expected to o-k a payment
in lieu of taxes deal for AES Somerset following
a half hour public hearing last night at the
Somserset Town Hall. About 35 people were
there and six offered comments generally in favor
of the agreement. The company will essentially
get the same deal that drew overflow crowds in
opposition 39 months ago in the Barker School
Auditorium. AES will pay a total of $15.8-million
each year instead of being taxed on the assessed
value of it's coal burning power plant. The deal
will run five years.

NIAGARA FALLS COUNCIL MEETING
Lawmakers in the Falls voted 4-1 last night
to spend $180,000 on a series of six concerts
this year in conjunction with the Hard Rock Cafe.
Charley Walker cast the no vote. He said he was
concerned the extra concerts would mean
more overtime for the police and the department
of public works and he wondered if they actually
produced that much revenue for the city and the
businesses in the area. Mayor Paul Dyster said
the Administration was bringing up the proposal
now so they do better planning and promotion. He
said they had not finalized their concerts last year
till after event calenders had already been printed.
He said he hoped private sponsors would take
over more of the cost in future years. The Council
tabled a request to spend as much as $40,000
on a three day Summer blues festival until they could
get more information about it's budget. They rejected
a request to contribute $25,000 of casino revenue
to the celebration of the bi-centennial of the War of
1812. They wanted to know how much was being
contibuted by other communities. The City's
representative on the Water Board, Tom vitello,
said he was upset Dyster chose to replace George
Morreale on the five member board. Vitello said
Dyster did not return phone calls about the
appointment and had replaced Morreale...who lives
in the city....with someone who does not. That's
Mike McNally of Cambria. He served as chairman
until his term expired and he was replaced last year.
Dyster said Morreale had been appointed by former
Mayor Vince Anello on the last day of his term and
he wanted to pick someone on his own. McNally
told reporters he was concerned Vitello, Morreale,
and new member Joe Schiro were attempting to
forgo a six month search for a new executive
director and were trying to hire a candidate that
was less qualified than the top finalist. Current
director Gerry Grose is planning to retire at the end
of the month. The Board is expected to hire a new
chief later this month.

STATE OF UPSTATE
The Governor will deliver his State of the Upstate
message today in Buffalo. Paterson is slated to
speak at 3:30 in the auditorium at the Buffalo
Museum of Science on Humboldt Parkway. He
also said Monday his 2010-2011 executive budget
proposal will not only meet, but exceed the
requirements of his inflation spending cap. He
said if it's enacted, it will generate a more than
$1-billion surplus in the 2011-2012 fiscal year.
He promised it would be returned directly to
property taxpayers in the form of a progressive
circuit breaker tax credit that would average about
a thousand dollars per recipient. The proposal is
included in his proposed executive budget. His
office says it would be calculated by limiting an
individuals property tax burden to a specified
percentage of their income. The percentage would
decrease based on the size of the surplus. It
would be limited to household incomes up to
$200,000 upstate and $300,000 downstate. Those
having incomes below $90,000 upstate and below
$120,000 downstate would receive the largest
benefit.

STUDENT CHARGED WITH SELLING DRUGS
A 9th grader at Niagara Wheatfield has been suspended
from school after he allegedly sold drugs on school
property. Officials say they found five yellow pills in the
battery compartment of his cell phone last Thursday. He told
them they were an anti-depressant called Seroquel. The
boy was caught after another student was brought to the
nurses office for a reported drug overdose. He left class
unable to walk straight or speak clearly and said he paid
the other boy a dollar for the pill. The Sheriff's Department
says the teen will be treated as a juvenile and could be
charged with the criminal sale of a controlled substance
on school grounds. He will also face a Superintendents
hearing before being allowed to return to school.

MARSHAWN LYNCH
Hamburg Police say Bills running back Marshawn
Lynch took $20 from the wife of a Buffalo Detective
Sergeant but she does not want to pursue criminal
charges. Detective Sergeant Thomas Best said the
wife told them her hubby had taken out of context
how Lynch took the money while she and friend
were leaving a restaurant. Best said the money has
been returned by mail and what's happening between
Sergeant William Crawford and Lynch's agent is no
longer considered a police matter. Crawford said he
is considering a defamation of character suit against
Lynch's agent over a statement he issued Saturday
lambasting Crawford and denying Lynch took the
money.

QUALITY MARKETS
Tops is expected to get the o-k to buy all of
the 79 food stores owned by the Penn Traffic
Company by January 25. Their $85-million bid
has been accepted by the company but it still
needs approval by a bankruptcy court judge
and that will be determined during a later
hearing. If Tops bid is rejected, another
bidder could step in because court documents
say the deadline to submit a bid does not end
until January 19. Penn Traffic owns the Quality
Food Stores in our area.

JANUARY THAW?
We haven't been above freezing since New Years
Day, but the National Weather Service says
temperatures should reach the low 30's
by Wednesday and lots of sun with high's
in the upper 30's can be expected Thursday.
There's a chance of rain and snowshowers
Friday but temperatures are still expected to
peak at about 34. A cold front will come by
Saturday and drop them back into the 20;s,
but we should bounce back to 32 or so Sunday.
Forecaster Dave Sage told us they have recorded
48.3 inches of snow so far at the airport, about
2 1/2 inches above normal. He says most of
it fell this month, that we're 14.2 inches above
normal so far for January.

CHURCH AT SHAWNEE LANDING
The Church at Shawnee Landing is planning to
buy the former Saint Joseph's Catholic Church
in North Tonawanda after abandoning plans to
build one in Wheatfield. Church moderator Vic
Baker said they will sue the Town if they rezone
the land they own there without their consent.
Baker says they have almost reached an
understanding with the diocese....and spokesman
Kevin Keenan confirms they are in negotiations.
Saint Joseph's closed in June 2008 and merged
with Our Lady of Czestochowa. The Church At
Shawnee Landing was formerly known as The
Payne Avenue Christian Church. A public
hearing on the rezoning is slated for January 25.

CIGARETTE TAX INCREASE?
The Governor talked about the possibility of
raising the State cigarette tax during an interview
Sunday on a Syracuse radio station. A Paterson
spokesman had dismissed a rumor last week that
he might propose an increase of a dollar a pack
when he unveils his 2010 budget plan in a week.
However, Paterson said Sunday that if things get
rough, he might use the tax to pay for health care.
The State already charges a tax of $2.75 a pack.
Any increase would give Indian retailers an even
larger price advantage over non-Indian stores.

surveillance tape was obtained from the funeral
home. Gray was also charged with unreasonable

after they allegedly found him sleeping behind
the wheel..with his car in drive....at the corner of
Washington and Prospect. He said he had been
drinking at his father's house and was on his way
home.
