DEWITT CLINTON

Over 200 people showed up last night to celebrate the
85th birthday of Lockport's DeWitt Clinton Elementary
Schhol and it's impending closure. The ceremonies
included a speech by principal Amy Moeller as well
as special guest speakers who have contributed to the
school. The celberation included the singing of the
school song. Attendees looked at displays of old
text books, photo albums, newspaper articles, and
school memorabilia. The school is being closed at
the end of the term to save money.

CANAL STREET MYSTERY

Nobody was saying much yesterday after the
Greater Lockport Development Corporation held
a closed door meeting on the future of Canal Street.
The Board spending about an hour with developer
David Ulrich on a plan he has for the three buildings
on the block. They also met privately with an official
from Waterbourne Real Estate, a company they've
hired to try to find tenants for the buildings. Corporation
Counsel John Ottaviano said there are three local
companies or individuals wanting information
about the structures. One is said to be retail, another
is food related, and the third is described as semi -tourism.
Ulrich repeatedly told reporters "no comment" when
they tossed questions at him as he left.

PALADINO

Gubernatorial hopeful Carl Paladino started a
campaign yesterday to collect the 15,000
signatures he'll need to force a Republican
primary with endorsed candidate Rick Lazio.
The Buffalo developer said he would spend
$10-million of his own money, an amount Lazio
can't mathc. The former Congressman easily
beat Paladino for the party endorsement
Wednesday at the GOP convention in New York
City.

BANK ROBBER

A Buffalo man whose plead guilty to bank robberies
in Erie County admitted to another one yesterday in
Niagara County Court. Thirty-two year old David
Anderson plead guilty to last November's robbery of the
M&T branch in the Falls. Judge Sara Sheldon Sperrezza
said Anderson would be sentenced ti 2 1/2 to 5 years
in prison when he's sentenced July 29.

TACO BELL

The former Long John Silver's building in the Town
of Lockport will be torn down and replaced by a
Taco Bell. Town Building Inspector Brian Belson
says the Planning Board will consider the site plan
next Wednesday.

CANAL STREET/NUISANCE LAW

Lockport developer David Ulrich will meet
behind closed doors at 4pm today with the
Greater Lockport Development Corporation
about his ideas for Canal Street. Mayor Mike
Tucker said yesterday everyone on the board
has to sign a confidentiality agreement or
Ulrich will not speak. Tucker said a
representative of the real estate company they
hired to seek tenants for the three buildings
would also address the board after Ulrich.
They're expected to present a couple of other

prospective ideas. Corporation Counsel John
Ottaviano said any deals would have to be
approved by the Council and he expected they
would be revealed next week. The council also
talked about the third revision to second
ward alderman Jack Smith's proposed nuisance
law. It's the one that would set up a point system
for code violations and criminal charges and gives
the city the power to close buildings and evict
residents if they pile up enough points. The latest
version gives the power to evict people to a board
rather than the Common Council. The board would
consist of a representative from each ward. They
would be appointed by the Mayor and approved by the
Council. Smith said all the calls he's received so far
have been favorable.

HERO

A 46 year old instructional associate for the Newfane
School district is being called a hero for saving the
life of a young boy on Friday, May 21. Donna MacFarlane
is also a bus driver for Ridge Road Express. She told
WLVL she got a call from another driver about a
situation on her bus where a boy was choking on a
piece of candy. MacFarlane had just dropped off
the last of her students and rushed to the other
bus in Wrights Corners where she performed the
heimlich maneuver on six year old Sam Capen of
Burt. He's a student at DeSales in Lockport and he
was on his way back to his "home" school in Newfane.
MacFarlane said she knows the boy's family, but
didn't know he was the one choking until after
she got there. MacFarlane was said to be very
humble when she was honored by the School Board
Tuesday night. She's also been nominated for a
national award by the Red Cross.

GOP CONVENTION

Carl Paladino is expected to try to force a GOP
primary by collecting 15,000 signatures on petitions
after the party chose former Congressman Rick Lazio
as it's candidate for Governor yesterday in New York
City. Lazio's win was a huge loss for party chairman
Ed Cox and his handpicked candidate, Democrat
turned Republican Steve Levy. Levy did not get enough
support to face Lazio in a primary. He hinte dhe might
try to run on a third party line. Paladino got about
eight per cent of the vote, mostly from Erie, Orleans,
and Genesee counties. The party also endorsed Staten
Island DA Dan Donavon for Attorney General. The
convention goers will choose someone to run against
Senator Kirsten Gillibrand today and are expected to
nominate Chautauqua County Executive Greg Edwards
for Lieutenant Governor.

DE WITT CLINTON

Lockport residents will get a chance to say goodbye
tonight to the soon to be closed DeWitt Clinton Elementary
School. One of the special collections on display was
found in the former home of a teacher at the school.
Miss Bender left behind spelling books and work papers
from the 60's. The students names are on them and you
can see how they were working on their writing and spelling.
The event will run from 6 till 7:30 tonight. It'll start at the
Clinton Street doors where there'll be short remarks from
the current principal, students, and a former teacher who
retired last year after spending her entire career at the school.
The chorus will sing the De Witt Clinton School song, it
was written by a teacher before she passed away from cancer
several years ago. They'll also take orders for this year's
school T-shirt and some notepads they're selling featuring
a picture of the school. De Witt Clinton will close at the end
of the term after 85 years.

TOPSOIL

An Appleton businessman told lawmakers in the Town
of Lockport last night a proposed law that would
require developers to pay for topsoil removed from
residential subdivisions would chase him and other
developers away. Dan Furmanek owns DDR Development.
The law would require that at least six inches of
topsoil be left on each subdivision, but developers could
remove the rest and sell it, providing they buy a
$250 permit and pay the Town 50-cents for each
cubic yard they sell. Furmanek has recently developed
two subdivisions in the Town. A vote is expected July 7.
The Board last night passed laws restricting the use of
snowmobiles and outdoor wood burning furnaces last
night. The snowmobile law prohibits their use on
town owned land or on the shoulders of roads. The
furnance law requires them to be at least 150 feet from
a neighbor's home and at least 40 feet from the property
line. It also says only wood can be burned in them.

PRICE IS RIGHT

A week long trip to the Falls and other spots in the
county will be a featured prize on Friday mornings
edition of The Price Is Right on CBS. It includes a six
night stay at the Barton Hill Hotel and Spa in
Lewiston and passes to more than a dozen attractions
including the Lockport Locks and Canal Cruises, Old
Fort Niagaram and the Whirlpool Jet Boats. The
Niagara Tourism and Convention Corporation worked
with the producers to offer the prize....and two other
packages that'll come up later in the year.

MOUNT SAINT JOSEPH'S

The Board of Trustees at Mount Saint Joseph's
Academy have announced they will close the school
at the end of the term. The decision was prompted
by a fall in upper class enrollment and the unexpected
departure of the headmaster. Scott Fike is leaving to
become the principal at DeSales Catholic School in
Lockport.

WINGSTOCK

The NCCC Alumni Association says Saturday night's
Wingstock event at the Rapids Theatre is open to the
public. They're calling it a trip back in time to the
60's and 70's with music from local bands including
Reflector and the BBC Band. The event will feature
restaurants competing for the best chicken wing.
There'll also be a basket auction with proceeds going
to provide scholarships. It runs from 7 till midnight.

slightly higher prices.

PANTS

A Falls man was robbed of his pants, phone charger, a
pack of smokes, and $50 cash around 2am yesterday in
the 1300 block of Ashland Avenue. The Centre Avenue
resident said his attacker asked him if he had gotten
his social security check yet, and when he said he had
not, he was beaten and robbed by the man who held a
knife to this throat.

FALLS DRUG PHONE

Falls police say they have shut down a pay phone
at 19th & Walnut that addicts used to make drug
deals. Officers say they followed a 30 year old
City of Tonawanda man in an unmarked car after
he used the phone for four minutes. He then drove
to a house in the 1700 block of Ferry Avenue where
he left after four minutes. They allegedly found
22 various narcotic pills when they pulled him
over for speeding.

COUNTY LEGISLATURE

County lawmakers passed a resolution last night
urging State Attorney General Andrew Cuomo to
investigate the State Comptroller's management of
the public employees pension fund. It was sponsored
by Lewiston representative John Ceretto, who
remarked that the county's cost rose from $4.7-million
to $8.5-million in just one year. Majority Leader Rick
Updegrove feared it could increase to $10-million next
year. A proposed law that would charge trucking
companies a $500 yearly fee to haul hazordous waste
into the County was sent to a committee. It's sponsor
is Clyde Burmaster of Ransomville. He says there have
been leaks from trucks in the past and the fee would
offset any cost if there was an incident. Chairman Bill
Ross said the Erie Niagara Tobacco Free Coalition
would be at their next meeting and present some anti
smoking signs they want posted in county parks.

NIAGARA FALLS CITY COUNCIL

Soon to depart Falls Fire Chief Bill MacKay got a
standing ovation and a heap of praise during
yesterday afternoon's work session. Council
President Sam Fruscione said MacKay came to
the city four years ago and he had modernized
the departments equipment, community outreach,
and pushing smoke detectors for safety. He thanked
MacKay for bringing the department into the 21st
Century. MacKay brushed aside some tears as he
said it was an honor and privilidge to work in the
City. He said he worked with some really great
people everyday, that all he ever did was "what
was right." His last day will be this Friday. He'll
be accepting a new post in Goochland County in
Virginia, near Richmond. The Council adopted a
mock resolution forbidding him to leave and
demanding he stay. A search is underway for a
successor. Fruscione also sparked a lengthy
discussion when he asked the Mayor why the
grass was not cut on two main gateways to the city
in advance of the Memorial Day weekend. He said
John Daly Boulevard and Hyde Park Boulevard were
the routes that many take into the city and they
looked horrible. Dyster said a last minute problem
with pay rates caused the work not to get done.
He said the council already approved a package
for the work but there was a snag. He said the work
will be done and it will be done right. The conversation
eventually evolved into a discussion about car
burglaries and unlicensed vendors and other problems
in the downtown area. Council member Bob Anderson
suggested they needed a hundred more cops on the
force. Police Chief John Chella said 16 new officers
would be joining the force soon.

UNITED WAY

The newly merged United Way announced Tuesday
Sheriff Jim Voutour will be in charge of this Fall's
fundraising campaign. The Assistant Superintendent
of the Lockport school system, Michelle Bradley will
head the campaign on the eastern side of the county
while retired Falls school principal Marilyn Lojek
will be repsonsible for activities on the western side.
UAW Local 686 president Paul Entwistle will be in
charge of the labor side of the appeal. The goal will
be determined next month and announced in August.

DOLLAR GENERAL

A 46 year old Falls man has been charged with Monday's
burglary of the Dollar General on Niagara Falls Boulevard.
Greg Stephens of Ferry Avenue also allegedly admitted to
being responsible for a crime spree in a city parking lot.
Police said a 25 year old worker at the Dollar General ,
Jennifer Sattleburg of 79th Street, drove Stephens to
the store and provided him with the codes to get inside.
His actions were captured on the store's surveillance
camera. Police also charged him with auto stripping
two vehicles after he was seen by a witness breaking car
windows in city lots on Third Street Monday night. He
plead not guilty to a long list of charges in City Court
Tuesday. Sattleburg also plead not guilty to third
degree burglary and petit larceny.

TOSSED CIGARETTE THOUGHT TO BE CAUSE

The Sheriff's department says a cigarette tossed by a
15 year old boy probably caused Monday night's fire
on Main Street in Gasport. A 12 year old boy said he
and some friends were "hanging out" behind the
building near the train tracks and a 15 year old
tossed a cigarette on a small pile of cottonwood.
It caught fire, they tried to put it out but it
spread and they told their parents who called
911. The building was used for storage and
contained a variety of equipment. We incorrectly
reported yesterday the blaze was in the Deja Vu
Salon next door. It's fine and was not damaged
in the fire.

TOWN OF LOCKPORT

Town of Lockport Supervisor Marc Smith said Tuesday
they are following up on 16 leads obtained during last
week's shopping center convention in Las Vegas. The
Town also received names and a number of specific
developers and site selectors to call. Smith said a good
location helped, the Town's booth was right across from
the national food chains and they were giving out samples.
Smith also said Tuesday the Town will be taking over
Stahler Cemetery on Beattie Avenue after it's management
decided to go out of business. The cemetery originally
belonged to the Zion Church on Raymond Road which
disbanded in the 1880's. Smith said there is still some
space in the one acre graveyard and they may sell some
plots to take care of the maintenance costs.

PLEA DEAL OFFER

County prosecutors Tuesday offered a Hartland
woman a week to think about accepting a plea
deal for allegedly stabbing her boyfriend to
death Christmas morning. Gwendolyn Garcia
had been indicted on a charge of first degree
manslaughter. The deal would reduce it to
attempted first degree manslaughter. Garcia
told sheriff's deputies she killed 38 year old Randy
Whitney in self defense. She called 911 to report
the stabbing and was talked through an
unsuccessful CPR procedure over the phone by a
dispatcher. She's originally from New Jersey while
Whitney was from Rochester.

BETTER WORKERS?

The owner of a Lockport company who said he would
buy drugs for his employees so they would perform
better at work was sentenced Tuesday to 2 1/2 years in
State Prison. Twenty-six year old Jerimiah Johnson of
Timberwood Court plead guilty in March to possession
of a controlled substance. He was found to have 1.87
ounces of oxycodone last November. He owns All
American Construction.

GOP CONVENTION

Republicans Tuesday endorsed a former CIA station chief in
Afghanistan as their candidate to challenge Senator
Charles Schumer in November. Gary Berntsen is a favorite
of the Tea Party movement. It's expected he will be
challenged in the primary by Jay Townsend, an Orange
County political consultant. The party also endorsed Harry
Wilson as it's candidate to oppose incumbent Democratic
comptroller Tom DiNapoli. They are expected to choose
their gubernbatorial candidate today. It's not known if
front runner Rick Lazio has the 5o percent support needed
to gain the endorsement. Republicans will choose their
candidate for Lieutenant Governor ...and for someone to
run against Kirsten Gillibrand ...tomorrow. The convention
is going on in New York City.

EXPOSURE

State Police Tuesday charged a 50 year old Appleton
man with exposing himself to a woman last month
as he drove next to her on Transit Road. William
Murphy of Gow Road allegedly drove his '99 Chevy
Lumina alongside the woman's vehicle just after
7am on May 21. He's due in court June 8. Anyone
who witnessed similiar activity involving Murphy or
his vehicle are asked to call the State Police at 434-5588.

MOTORCYCLE ACCIDENTS

Two men are at ECMC following two motorcyle
accidents that happened within two hours time
Monday. The second left a 27 year old Sanborn man
in critical condition in a medically induced coma
at ECMC. It happened around 6:30 last night at
4753 Mapleton Road in Pendleton. The Sheriff's
Department says Matthew Szymanski was going\
West on Mapleton when a vehicle operated by
25 year old J Fitzpatrick of Niagara Falls turned
into a driveway in front of the bike. Szymanski
was unable to stop and laid the motorcycle down on
it's side trying to avoid striking the car. The
motrocycle struck the passenger side rear bumper
causing Szymanski to be thrown into the middle
of the Westbound lane. Fitzpatrick was issued a
ticket for failing to yield the right of way. Thwe
other accident happened just after 4pm at the
intersection of Lockport and Wheatfield-Pendleton
Townline Roads. The name of the biker has not
been released but he was taken to ECMC by Mercy
Flight. The driver of the car was said to be
21 year old Jonathon Ferguson of Lockport. He
was not hurt. The biker was found down on the
road with severe leg and arm injuries.

MEMORIAL DAY OBSERVANCES

County Treasurer Kyle Andrews told the story of
the oldest soldier to die in the global war on terror
yesterday as he delivered Memorial Day remarks in
Greenwood Cemetery in Wilson. Several hundred
listened as Andrews told how Army Major Steve
Hutchison survived his tour in Vietnam in the
60's...and how he re-enlisted at the age of 59 after
9-1-1. Hutchison was sent to Iraq where he was
killed when a roadside bomb went off last year.
Sheriff Jim Voutour, County lawmaker Dave Godfrey,
and members of the Town and Village government
participated in the ceremony put on by American
Legion Post 836. Legilsature Chairman Bill Ross
led a similiar gathering at the Wheatfield Highway
Department on Ward Road. Solemn Memorial Day
observances were also held at Academy Park in
Lewiston, it was accompanied by a more boisterous
parade down Center Street.

FIRE ON MAIN STREET IN GASPORT

A fire around 7:30 last night totally destroyed a
commercial building at 4440 Main Street in Gasport.
It housed the DeJa Vu salon and a scrap metal hauling
and salvage operation. Damage was estimated at
$20,000. six fire companies were there including
Gasport, Middleport, Terry Corners, Wolcottsville,
Wrights Corners, and Hartland. The wood frame
structure owned by Denise Hook. The cause is under
investigation.

DOLLAR GENERAL

Falls police say a man who broke into the Dollar
General on Niagara Falls Boulevard around 3:30am
yesterday used an employee pass code to deactivate
an alarm and another to open the safe. Surveillance
tapes show the man approaching the building and
punching in the codes to get inside. Police said
$294 in one and five dollar bills were taken from the
safe beneath the cash register. The man is said to
black and between 20 & 25 years of age. He's about
six feet tall and weighs around 175 pounds. He was
wearing white shorts and sneakers and had a black
hoodie pulled up over his head. Police are checking
into possible connections to the two store employees
who have access to the alarm and safe passcodes.

SEVERAL BUILDINGS SOLD

An electronics company from Hong Kong has
bought a vacant manufacturing and warehouse
facility at 85 Grand Street in Lockport from the
Jamestown Container Corporation. The price was
$495,000. The 145,000 square foot, three story
structure has been empty for about six months
after Jamestown Container moved it's operations to
other plants. In the Falls, the Regal Cinemas at
Girard Avenue and Builders Way have been sold
the president of Dipson Theatres for $5.6-million.
Michael Clement...and a partner, Jon Goldstein,
say they have no plans for any changes to the
property or the building. He said they're theatre
owners and it's an investment. Clement saying
Regal has a good operation but if something were
to happen they could step in and operate it. Sunoco
has also sold a building they owned at 6390
Niagara Falls Boulevard to Carlton Hasselback
Junior for $254,000. The property at the intersection
with Builders Way used to be a Gray Line Tour and
Falls Sightseeing operation.

HIKERS RESCUED

Three hikers who got stranded as they walked in the
Niagara Gorge underneath the Rainbow Bridge were
rescued late Monday afternoon by city firefighters and
the State Police. It't not known how long they had been
in the Gorge before one of them called 911 and said they
needed help. Firefighters and Parks Police walked down
and escorted them up the side. They did not appear to be
hurt but were taken to the Medical Center for evaluation.

REVENGE

A 23 year old Falls woman who was slashed across
the face with a razor around 3am Monday got her
revenge less than an hour later. Police said she pulled
her alleged assailant...who gave an address on Cedar
Avenue... out of a car and beat her up with the
help of another woman. The victim said she was jumped
and slashed as she walked to her car in the 600 block of
19th Street. She suffered a small cut that required stitches
to close. The victim and another woman returned and
pulled the alleged assailant out of car at the same
location and beat her up before she was able to break
loose and flee.
