STATE SENATE

The State Senate yesterday held another of it's
speedy, do-nothing sessions as lawmakers
prepared to spend the holiday weekend in
Albany. State Senator Bill Stachowski said
it wouldn't be the first time he's spent a holiday
in the Capitol. He said they may not be
accomplishing anything on the floor but he
would still be working on e-mail's and reading
bills. Despite his assertion that he'd still be
working , State Comptroller Tom Dinapoli
said the Senators would not be paid not week.
Meantime, negotiations to end the stalemate
stepped up last night. The Governor had both
sides in his office for a talk that lasted over an
hour. Former Senate leader Malcolm Smith
said he thought Paterson had brought them
together but Brooklyn Democrat John Samson
said "there is no deal."

MORE SECURITY

There'll be two extra security officers on duty
tonight following the concert by Our Lady Peace
at the Ulrich Center in Lockport. David Ullrich will
pay to have two uniformed city police officers
stationed outside the Main Street entrance from
10:30 till 2:30am. The action was taken after some
trouble erupted in the archway after last week's
show and officers had difficuulty getting through
the crowd to address it. The two extra officers
will be paid about $44 an hour. Tonight's show
with the Canadian rockers is expected to draw one
of the largest crowds ever seen in the city. The
opening acts are Inward Eye and The Incurables.
Inward Eye is also from Canada. It's composed of
three brothers from Winnipeg, Manitoba. The
Incurables are another three piece outfit from
Wayne, Michigan.

TOO CLOSE TO THE SCHOOL

Representatives for the State Division of
Parole agreed yesterday that a boarding
house in the Falls housing 14 sex offenders
is too close to the Niagara Street Elementary
School. The regional director of the division,
Eugenio Russi, pledged to work to move them
from the Midtown Inn on Niagara Street but said
they would need hel[ in finding other locations
that don't violate a city law that says they cannot
live within 1500 feet of a school. He was one of
five officials from the Division of Parole that met
with school and community leaders during a two
hour roundtable organized by Assemblywoman
Francine del Monte. The Niagara Street Business
Association led protests in front of the Midtown
Inn last week after State Supreme Court Judge
Richard Klock ordered that a 51 year old North
Tonawanda sex offender should live there. The
President of the School Board said he did not
understand why it's taking so long to move
them.

WILSON HOUSE FIRE-DEPUTY BREAKS LEG

A Sheriff's deputy breaking his leg early this
morning as he was helping firefighters deal
with a small blaze at a home at 43 Sunset
Island in Wilson. It started around 2:15am
when sparks from a fireplace fell on a
couch. The couch was completly destroyed
and there was smoke and fire damage
throughout the home. The owners dealt
with some of it before crews arrived. Bob
and Barbara Dobosx suffered minor burns
to their arms and hands and were treated at
the scene. Deputy Ray Needle fractured his
left fibula when he fell down a set of wooden
stps leading to the home. He was treated at
Eastern Niagara Hospital-Newfane.

HOLIDAY ACTIVITIES

The rain held off last night and those attending
Lockport's Independence Day parade didn't
need an umbrella. The Pipe Band from our sister
city of Thorold Ontario was in the march that
started at 6:30 at the High School, went up Locust,
and ended at the Ulrich City Center. Antique cars,
firetrucks and city officials were joined in the
parade by four other bands and entries from
the likes of the Palace Theatre and Immanuel
Methodist Church. The city's fireworks are set
for Saturday night at Outwater Park. There'll
be a concert by the Lockport Community Band
at 6:30. In the Falls, DPW Director Dave Kinney
said they would spend $25,000 on a display that'll
be offered Saturday at Hyde Park. Wheatfield
Recreation Department spokesman Ed
Sturgeon said the Town's fireworks would
be at Oppenheim Park and be accompanied
by music. He said they would run about 35
minutes and urged people to get there early
as the park begins to fill up around 8. The Town
of Newfane has their traditional display over
the lake at Olcott Beach Friday night at 10. They'll
also have a kids march at 12:30 Saturday
starting at Krull Park and ending at Carousel
Park where they can ride the merry go round.
Activities in Pendleton begin at 5pm Saturday
at Town Hall with fireworks to follow. Royalton
will have it's annual blow out Saturday starting
with a chicken barbecue at 1pm at the Royalton
Ravine. There'll be a parade at 3:30 and music
by three bands starting at 5 to be followed by
fireworks.

FIREWORKS

A 17 year old Town of Lockport boy was charged
with possessing fireworks after Sheriff's deputies
stopped him Wednesday night on Rapids Road.
Stephen Boulden of Creekview Drive
reportedly passed a Sheriff's patrol car recklessly
as a deputy was picking up debris in the roadway.
The fireworks were in a box and a black plastic bag
in the back of the pick-up the teen was driving.
He was issued an appearance ticket for July 14 in
Town of Lockport court.

DOG JUMPS ON BOY

An 11 year old Lockport boy had three stitches
put on the back of his left shoulder after a German
Shepherd jumped on him around 5pm Wednesday
at a home on Old Beattie Road. The boy also had
three marks on his left bicep which appeared to be
minor puncture wounds. He lives on Birchwood
Drive and is friends with a 9 year old on Old Beattie.
The homeowner said the two asked permission to
play and the dog ran up to the 11 year old and
jumped on him as they were entering the garage.
She did not believe the dog bit the boy and the
injuries were caused by the dogs claws.

HOLIDAY TRAFFIC INITIATIVE

The State Police say they'll be looking for
impaired drivers, those who are speeding,
and others not using their seat belts over
the weekend. The 4th of July safety
initiative will run through Monday.

CREDIT CARD LIMIT

The Falls School Board agreed last night to
limit the charges that can be made on the
district's four credit cards to $50,000. The
change was in response to last year's audit
by the State Comptrollers office. School
Chief Cynthia Bianco, Deputy Superintendent
Mark Laurrie, Purchasing Agent Marie Maynard,
and District Clerk Ruthel Deumas are the only
one permitted to use them. The cards were
held by 38 employees prior to the audit. It
found that during the two year period covered
by investigators they had racked up $638,000
in charges.

YOUTH HOMES

The head of the State's Office of Children
& Family Services announced yesterday
she will appoint a group to tour about
70 homes for troubled teens similiar to the
one in Lockport where a counselor was
killed last month. Gladys Carrion said the
group would include State officials, workers
at some of the homes, and perhaps a
former resident. They would be charged
with making reccomendations and Carrion
said they wanted them by the end of the
Summer. State Senator George Maziarz
said he's not opposed to her forming the
group, but the answer is fairly simple.
She needs to reverse her policy of
putting potentially violent juvenile
offenders in non secure facilities like
Avenue House in Lockport. He said she
was appointed in 2007 she has closed
all the secure facilities that housed juveniles
upstate. State Senator Catherine Young of
Olean told the Buffalo News the staff at the
homes are getting the daylights beaten out
of them and all the children are considered
victims and they have to be treated with
kid gloves.

STATE SENATE SHOWDOWN

There'll be no holiday for the State Senate.
The governor announced yesterday he had called
special sessions for everyday through Monday.
His order came after another session yesterday
failed to come up with a different ending than the
many others that have been held since the dispute
over leadership began June 8. The Democrats
continue to insist that the 125 bills they passed
Tuesday when a Republican accidentally
entered the chamber are legal, but the Assembly,
where the bills originated, is refusing to send them
to Paterson's office. Paterson said even if he were
to sign the bills it would still be in dispute because the
Repubicans told him it would wind up in court, He also
said some of the bills relate to bonding and bond
councils will not act on them because it's in dispute
and the decision could be reversed. He also said
he would be violating three court orders that
said the Senate should resolve the leadership issue
themselves and as a governor he needed to abide
by the law. He said he might sign them if the GOP
agreed not to take him to court if he did. The
Republicans also charged in court yesterday that
Democratic Senate Secretary Angelo Aponte
illegally changed the minutes from the June 8
meeting.

WOJTASZEK QUITS HARRIS BEACH

The long time chairman of the County's
Republican party announced yesterday he
had resigned from the Harris Beach law firm.
Henry Wojtaszek said he plans to run for the
chairmanship of the state Republican party.
The 46 year old said he would make a final
decision within 45 days. He's currently the
party's Vice Chairman for Upstate Affairs.
He says he will keep his post as County
party chairman unless he is elected to the
state position. He's had the County post
since September 2000...but relinquished it
for a few months back in 2002 when he ran
unsuccessfully against Congresswoman
Louise Slaughter.

SMITH TRIAL

County Judge Sara Sheldon Sperrezza ruled
Wednesday that 21 year old Ryan Smith will
only get one trial even though he's charged
with two seperate crimes. Smith is the Falls
man who was tasered by police to get a DNA
sample. He's accused of the armed robbery
of a gas station and a home invasion that led
to the abduction of his ex girlfriend and the
shooting of another man. Smith's trial will
begin August 10. He faces a 24 count
indictment from the two incidents that
happened back in 2006. Sperrezza said
both crimes had robbery components which
made one trial acceptable.

HOLY TRINITY SOLD IN THE FALLS

The diocese of Buffalo confirmed
yesterday that the former Holy Trinity
Church was sold June 24 to a non
profit group called Niagara Heritage of
Hope & Service. The diocese closed
the parish on Easter 2008 as part of it's
Journey In Faith And Grace. The sale
includes the historic church, as well
as the rectory, convent, and school
buildings. The price was not disclosed
but the proceeds will go to Divine
Mercy Parish....which was formed
when the congregations of Holy
Trinity, Saint Stan's, Saint George's,
Our Lady of the Rosary, and Our
Lady of Lebanon merged. The website
of Niagara Heritage and Hope and
Service says they are seeking to make
a positive difference in the local and
visiting community by providing
educational services, professional
support, social opportunities, and
spiritual support and instruction.

A 24 OUNCE BOTTLE OF BUD

Lockport police chased three men down State
Road, through a backyard and onto High Street
around 12:30 this morning in connection with the
theft of a 24 ounce bottle of Budweiser from the
Wilson Farms store on South Transit. Two of
them got away but 17 year old Zachary Smith of
42 Ashley Place was caught and brought back
to the store. An employee said he was in the
store with a black male who took the beer....
but Smith did not take anything....so police
charged him with obstructing governmental
administration.

MIDDLEPORT BOY DOING BETTER

The condition of an 11 year old Middleport boy
who was hit by a car while riding his bike Tuesday
has been upgraded from critical to stable. The
youngster was hit at Cottage and Chestnut
Ridge Roads when he rode his bike into the
path of a car driven by a 19 year old Gasport
woman. Deputies say she was unable to avoid
hitting the boy and will not be charged.

SCREAMING

Thirty-one year old John Cuilo of 36 Spruce in
Lockport was charged with criminal trespass
after he allegedly showed up at a home on
Harvey Avenue around 2am and started
screaming on the front lawn. The resident
told police Cuilo wanted to see his girlfriend
who wasn't there. Cuilo refused to leave
and threatened to smash up the caller's
property. He was arrested at the corner of
High and Harvey.

WELCOME TO WILSON

A sign on Ide Road welcoming people to the Town
of Wilson was apparently damaged by an axe
sometime yesterday. A town worker discovered the
damage around 7 last night. Brad Clark told deputies
it appeared to have marks in it from an axe and the
bottom half had been broken off. Deputies found the
head to an axe pick in the ditch below the sign. Clark
said there have been ongoing problems with Wilson
signs being damaged, he estimated the value of
the sign to be $1600.

LOCUST STREET FIRE

Yesterday morning's fire in Lockport that
was centered around Macaluso's Shoe
Repair did an estimated$150,000 in damage.
Firefighters continued to throw water on
the remains of his store, and the adjoining
Locust Street Hobby Shop till early
afternoon. It was torn down later in the
day. The cause is still under investigation.
Owner Vincent Macaluso watched as the
building was being demolished. He said as
many as 50 people came by to express their
sympathies. He was able to save an antique
cash register and the handpainted sign made
by his Father. Macaluso is 62 and said
he's not sure yet if he's ready to retire. The
fire was spotted by police on patrol at 1:20am
and also reported by a resident of the rear
apartment. There were no injuries.

A CAN OF COKE

In Albany, Senate Democrats passed 125 bills
yesterday after they counted a Republican...
who had wandered into the Chamber looking
for a can of Coke...as being present. It gave them
a quorum and the Governor, who was holding a
press conference at the time, said witnesses saw
Senator Frank Padavan in the Chamber at a time
when his vote could be counted for non controversial
legilsation. He said if a Senator comes in the Chamber,
even if he or she leaves, their vote can be tabulated.
But within a few minutes, he said the Republican
conference said Padavan never signed in and
his 32nd vote would not be valid. Patersonn then
ordered the two sides back for another try last night
but nothing passed. A spokesman for the Governor
said last night he would not sign the bills passed earlier
in the day..even though there was speculation by
many that he would. Peter Kaufmann said the bills
would automatically become law in ten days if they
are sent to Paterson's office and he does nothing.
State Senator Antoine Thompson said the Democratic
conference might take him to court to force him to
sign them.

ELEVEN YEAR OLD STRUCK ON BIKE

An 11 year old boy is in critical condition at ECMC
after he was struck by a car while riding his
bicycle around 3pm yesterday at Chestnut
Ridge and Cottage Roads in Royalton. State
Police say the car was operated by 19 year
old Karita Cumberland of Gasport. She
was not hurt. The boys name was not released.
The investigation is ongoing and no tickets were
issued.

E-Z PASS SCREW UP'S

The State Thruway Authority admitted
yesterday a foul up with EZ Pass on Grand
Island led to the issuance of more than
2400 tickets to holders who were accused
of speeding through toll boothes. The foul
up happened between April 27 and last
Monday. They're sending out letters of
apology. A similiar screw-up occurred
earlier this year at the Dunkirk-Fredonia
State Thruway exit.

LAWYER QUITS

The attorney for a Falls man accused of shooting
two police officers and his girlfriend back in
February told Judge Sara Sheldon Sperrezza
yesterday he was quitting the case. Derek
Akiwumi said 34 year old Adam Hamilton needs
a psychiatric defenseand Hamilton doesn't have
the money to pay for it. The County's Public
Defenders office took over the case. If they
decide Hamilton needs a psychiatric expert,
the taxpayers will pay for it.

EXCESSIVE FORCE?

Falls Police Superintendent John Chella and
Council President Chris Robins will be getting
together today to discuss a complaint raised
by a Whitney Avenue resident during Monday
night's council meeting. Twenty-three year old
Michael Hayes said he was zapped by a taser
last Wednesday while he was trying to stop a
police officer from using it on his 15 year old
cousin. Hayes was charged with inciting a riot
but maintains the incident started as a childrens
water balloon fight. It happened at 17th &
Whitney and police claim an officer was hit by
a rock and a police car was damaged. Hayes
said he felt like his constitutional rights had
been violated and officers used excessive
force. Chella is hoping to address the complaint
before a lawsuit is filed.

SUMMER RECREATION

The Lockport Recreation Department reporting
it's Summer program is up and running in it's
8 parks. Each will feature a different theme
every week and there are arts and crafts,
co-op games, athletic contests and much more.
Wednesdays will be huge in the parks and starting
next week, there'll be kickball at Altro Park from
1 till 3 and an outdoor movie will be shown at 9.
The department will sponsor weekly field trips
on Thursdays starting next week. The first will
be to Skateland. They'll go to the Buffalo Zoo
July 16, the Fort Niagara Pool July 23, and a
Bisons game on the 30th. The Lockport Caves
are slated for August 6 and Fantasy Island August

SENATE UPDATE

The two sides in the State Senate showdown met for
a brief session this morning after a judge ordered them
to do so yesterday. They argued briefly over who would
control the proceedings and then adjourned with no
action taken on any legislation. Republicans appealed
yesterday's ruling by State Supreme Court Judge
Joseph Teresi prior to the start of the session. A three
judge federal panel has scheduled a hearing this
afternoon.

LOCKPORT FIRE

Firefighters say they'll be dousing the
scene of a massive blaze at 93 Locust with water
throughout the day. The fire started
around 1:20 this morning at Macaluso's Shoe
Repair and destroyed two adjoining stores
and two apartments above it. WLVL's Steve
Wallace was there about 15 minutes after the
blaze erupted. He said the blaze attacked the
walls of the upper apartments and the roof
eventually collapsed down to the first floor.
Lockport firefighters eventually determined the
building could not be saved and they focused
their efforts on saving the surrounding
buildings. Two residents of the apartments
were able to get out safely. There is no
estimate of damage and fire investigators
are on the scene along with nine members
of the department.

JOHNNY FLYNN GETS KEY TO CITY

More than 300 people filled the Council Chambers
in the Falls last night...and spilled into the
hall as Mayor Paul Dsyter presented NBA
draftee Johnny Flynn with the key to the City.
The room erupted in cheers and applause as
Dyster handed the 20 year old the silver key...
and announced he planned to start a basketball
tournament in his name. Flynn thanked his family
and friends and singled out team-mate Paul Harris
saying he was the brother he never had. He
said he had an entire City behind him including
the basketball gurus to those who couldn't
pick out LeBraun James if they saw him. He
said "I love you Niagara Falls." County lawmakers
also presented Flynn with a proclamation and
Assemblywoman Francine del Monte also
was there for the celebration.

NIAGARA FALLS TO BUY FORMER SPA

Lawmakers in the Falls last night o-k'd a
proposal to buy and tear down the former
Lotus Acupuncture facility at 446 Third
Street. Prosecutors say it was used as
a virtual prison for sex workers. The City
will pay the federal government about
$55,000 for the building and have it
demolished for as much as $25,000
more. The Spa was raided in 2007. The
City has already bought a piece of
adjoining property and plans to use the
space for parking.

YAHOO

Congressman Chris Lee joined Senator Chuck
Schumer in Buffalo this morning to announce
that Yahoo will build their new data center in the
Town of Lockport. The governor also appeared
via video conferencing. The facility is expected
to create 75 full time jobs and others involved
in the construction. The company submitted a
plan last night to the Town's Zoning and Planning
Boards that called for fewer buildings and slightly
less footage. They said the changes were to
improve ventalation. The Town IDA is slated to
vote on a 20 year property tax break at 3pm today.
The Planning Board will hold a hearing at 4pm
on the altered site plan. Construction could start
as soon as August.

SWINE FLU

The Health Department says 18 cases of swine
flu have been confirmed in the County but
they probably only represent a small fraction
of actual cases in the area. The majority
are in school age children. One pre-schooler
recovered at home after being discharged from
a hospital. The Centers For Disease Control
says the largest number of cases in the County
have been in those between the ages of 5 & 24.
Signs and symptoms include a fever greater
than 100 degrees, headache, sore throat, body
aches, and may include nausea, vomiting, and
diarrhea.

BREAK IN

Two Orleans County men were arrested around
9pm last night after they allegedly broke into an
apartment at 41 Locust in Lockport. Twenty-seven
year old James Richards Junior of Route 31 in
Medina and 29 year old Enrique Fierro of 21 Platt
in Albion were caught in Middleport after they
were allegedly involved in a hit and run. Sheriff's
Deputy Brian Grear noticed a stash of items that
appeared to have been hastily thrown into the
back seat and it was determined they had been
stolen in Lockport. The victim told police he got
home and found his door kicked in and his
apartment ransacked. Both are charged with
burglary, criminal mischief, and possession
of stolen property in Lockport. Richards was
the driver and apparently intoxicated, additional
traffic offenses will be forthcoming from the
Sheriff's Department.

LOCKPORT MAN BEATEN IN PARK

An 18 year old Lockport man turned himself into
police late last night in connection with the
beating of another teen last Wednesday in
Grosi Park. Brian Morrow of 82 Niagara,
apartment West, is charged with assault.
A police officer who interviewed the victim
at ENH-Lockport said he had a large amount
of blood on his clothing, his face was swollen
in different spots, and his nose was bleeding
on the outside and it appeared it was doing
so internally as well. The victim told police
Morrow had been sending text messages to
various people that he wanted to beat him up
because he was seeing his girlfriend. Morrow
allegedly pulled up with friends and said
Lets do this. The victim was also with friends
and one of them took him to the hospital. He
said there was so much blood he didn't know
what else to do,

FLOOD PLAIN MAPS

Senator Chuck Schumer said Monday the Government
Accountability Office (GAO) will begin an investigation
into the methods and policies that resulted in FEMA's
issuance of those highly contested flood plain maps.
The probe will begin in about two months.

UPDATED WEBSITE

The Sheriff's Department recently revised
and updated it's website. The new name
is "Niagarasheriff.com." One of it's many
features gives you a chance to receive
automatic, daily, weekly, or monthly e-mail
alerts about crimes that occur near your
home, office, or school. You can also
view reported crime activity on an easy to
use map. There are links for sex offender
information. You can learn about the history
of the department and employment
opportunities. The update started in
January and the work was done in house with
no additional cost to taxpayers.

NIAGARA FALLS CITY COUNCIL

Niagara Falls Mayor Paul Dyster will present
the keys to the city to future NBA star
Johnny Flynn during tonight's 7 o'clock
council meeting. He was drafted last week
by the Minnesota Timberwolves. The Council
has it's regular 4pm work session today and
there are 27 resolutions on the agenda for
the 7 o'clock meeting. One of them calls for
the approval of $102,000 in overtime for the
various divisions of the Department of Public
Works. Meantime, Council President Chris
Robins says they are accepting applications for
a position on the City's Civil Service Commission.

of civil service law, and be able to attend meetings
of the Commission as set by the Human Resources

UNSETTLED WEATHER

It won't be raining all the time, but there is a
chance of showers and thunderstorms every
day for the next seven. National Weather Service
forecaster Steve McLaughlin says a big upper
level low is moving into the Great Lakes and it's
expected to park itself in the region for the
entire week. It's causing it to be very cool
aloft and as soon as the region gets some
daytime heating we start to get bubble-up
showers. We're starting to share in what's
been happening East of us all month. It's been
mostly cool and wet in Boston and New York
City. Temperatures in our area have averaged
a degree and a half below normal in June.
There were only five days when the temperature
reached 80, normally there are about nine or
ten.

ALBANY UPDATE

The Governor has called another special
session of the State Senate for 3pm today
after negotiations to decide who'll run the
body collapsed again last night. There are
101 bills on the agenda including Niagara
County's request to extend it's sales tax
surcharge which expires in November. Paterson
and Senate democrats met for 90-minutes
last night behind closed doors. Tenative deals
were reportedly reached on sharing resources
for staff and pork barrel spending but the stumbling
block remains who'll run the Senate. The dispute
also returns to court today. Paterson asked a
judge last week to force the two sides to
convene in a special session at the same time
so he can get a quorum to pass the bills.

CLIMATE CHANGE BILL

Congressman Chris Lee voted against the
climate change bill that passed the House
of Representatives Friday night. An EPA
study shows it will hike the price of gas
by as much as $1.60 a gallon but that did
not seem to bother our other representative,
Congresswoman Louise Slaughter. The bill
is commonly called "cap & trade," and while
he was running for President, Obama told
the San Francisco Chronicle it would cause
electricity rates to skyrocket. Many say it
will also kill jobs, but Slaughter calls it
an investment in clean renewable energy.
She said it would cost the average family
less than $10 more a month but most say it
will be a whole lot more. The Tax Foundation,
which has released information in the past
about our county's highest tax status, has
information about it's projected true costs,
on it's website at TaxFoundation.org.
The bill barely made it through the House,
passing 219-212. It must still get through the
Senate.

UNDERAGE DRINKING PARTY

Lockport police charged 20 year old Jeffrey
Farrell with providing the alcohol when they
broke up an underage drinking party at 3am
Sunday. The gathering took place at Farrell's
home at 53 Dayton. Police said they found
numerous empty beer cans and they could
smell the odor of alcohol. Farrell was charged
with unlawfully dealing with a child.

PENDLETON HOUSE BURGLARY

A Pendleton couple telling Sheriff's deputies
Saturday a $1000 laptop computer and $700
in cash were stolen from their home during a
daytime burglary. The residents of Mapleton
Road said they left their home at 7am Saturday
and discovered the break-in when they got
back around 3. Entry was apparently made
through the garage. The handle on the door
was dented and a pry mark was seen on the
weather stripping. A 32 inch $500 TV was also
taken. The victims had recently evicted a
friend from the home and he denied any
involvement when interviewed by deputies.

TIM HORTONS

A 19 year old worker at the Tim Hortons
on Niagara Falls Boulevard in the Falls
accused yesterday of stealing $400 worth
of credit cards. Ashley Crawford of 15th
Street was charged with petit larceny. The

HARTLAND ACCIDENT

Three people were hospitalized following a
two car crash around 7 o'clock Saturday
night in Hartland. It happened at the
intersection of Carmen and Seaman Roads
as one car allegedly tried to make a left turn
in front of the other. Mercy Flight took one
woman to ECMC while an ambulance took
another man to the same hospital. A third
man was taken to ENH-Lockport. No names
were released but their injuries were said to
be non life threatening. One of the drivers
was charged with failing to yield the right of
way.
