ROYALTON

A 63 year old Royalton man is facing charges after
he allegedly fired off 15 rounds with a rifle yesterday
morning as he confronted two Lockport residents
who were allegedly trying to break into his home at
7643 Akron Road. Dennis Cherry was charged with
felony counts of reckless endangerment and
criminal mischief and a misdemeanor count of menacing.
State Police say 18 year old Jenna Zsebhazy of Washburn
Street and 24 year old Anibal Cordero of Dysinger Road
drove to the home together and that Zsebhazy attempted
to get inside through an open garage door. That's when
they were confronted by Cherry. He detained the girl
while Cordero attempted to flee in the vehicle. Cherry
is accused of firing 15 rounds at the vehicle and Cordero
jumped out and fled on foot. He was captured a short
time later in the woods. Zsebhazy and Cordero are
charged with felony counts of attempted burglary.
They're being held on $5,000 bail. Cherry was released
on his own recognizance by Royalton Town Judge
Greg Bass. He will be back in court January 28 at 5pm.
Zsebhazy and Cordero are slated to reappear in court
on February 1.

WATER RATES TO GO UP IN THE FALLS

The Niagara Falls Water Board last night o-k'd
a $25.4-million budget that'll hike water and
sewer rates by 2 per cent. The vote was 3-2.
The increase takes effect next month, the
yearly impact will be about $12 for the average
customer. The Board also voted to hire
Executive Director Gerry Grose to serve as an
independant contractor for a month after he
retires January 31 while they continue to search
for his replacement. He'll be paid $9,000.
In a 2-3 vote last night, the Board said no to
a plan to hire former councilmember Glen
Choolokian as the Executive Director. The
search has divided the Board since December.
They are currently talking to North Tonawanda
about a plan to share their Executive Director
Paul Drof. He would oversee water and sewer
treatment plants in both cities if they can reach a
deal.

The Chapel At Cross Point will begin holding
branch services at Lockport's Palace Theatre

administrative offices and for special programs
aimed at men, women, and children. Fourth Ward
alderman Andy Chapman is a member of the
church. He said they would also donate a
high definition projection TV system to the
Palace and make a contribution to it;s

the department said it rose from 8.3 per cent in
November to 9.4 per cent last month.

ANDREWS RELEASES REFORM PLAN

County Treasurer hopeful Kyle Andrews released
a four point reform plan Thursday that he said
will restore faith in the office. The Democrat is the
only announced candidate so far. He said if he's
elected, he will ban all relatives from working as
outside vendors for the office. He would also bar
the office from outsourcing work to any companies
in which relatives of the Treasurer, or Treasurers
Office employees, have a substantial financial stake.
It would also affect lawyers working directly for the
office. Andrews promised to maintain a list of all
outside vendors, ensure transparency in the
management of funds from estates, and provide
records related to the administration of estates
to the courts for review at any time, except those
that are protected by privacy laws.

LOCKPORT REPUBLICAN COMMITTEE

Glen Aranow was elected Chairman Monday of the
City of Lockport Republican Committee. Dave
Licata was chosen as Vice Chair, Tom Grezbinski
as Treasurer, and Erin Norris is the new Secretary.
Former Chair Ken Genewick resigned after being

September. Aranow says his priority is to
recruit new members who want to work to win elections.
Call him at 434-7474.

FALLS SCHOOL BOARD WORRIED

The Niagara Falls School Board was told last
night they will face a budget deficit of between
$1.6-million...and $4.9-million....depending on
whether the State Legislature approves the
Governor's plan to cut school aid. Paterson said
Tuesday he would propose $1.1-billion in cuts,
and if it's approved, the Falls would lose $6.3-million.
The Budget Manager said it would be devastating.

ACCIDENT ON ROBERT MOSES PARKWAY

A Youngstown man was taken to ECMC with
serious injuries Thursday after his SUV rear-
ended a State DOT truck doing patching work
on the Robert Moses Parkway near Pletcher
Road. Michael Gifford of Fieldcrest Drive was
treated for possible fractures to both his legs
and sternum. Lewiston Police said Gifford
might have been distracted by an electronic
device, such as a cell phone, or he might
have been texting, when he hit the truck.
Police are checking phone records. The
State truck had a caution arrow on the back
and it was travelling at a slow rate of speed.
The driver, 49 year old Luis Santiago of
Mount Hope Road and a passenger, 45
year old Robert Pino of the Town of
Tonawanda, were treated at Mount Saint
Marys for minor injuries.

who is incarcerated at the County Jail has been writing
sexual letters toher 16 year old grandson. Tajhsa Maye
is in jail for a previous charge of endangering the welfare
of a child along with a sex offense, both involving the
16 year old. The grandmother gave deputies four letters.

and drawings. The grandmother wants to pursue
criminal charges against Maye and to have an order of
protection telling her to stay away from the boy.

LOCKPORT CONCERT SERIES DEAL

Lockport lawmakers voted 4-2 last night to
extend by three years the city's contract for
the Molson Canal Concert series. Alderman
Andy Chapman tried to delay the vote for
30 days citing concerns promoter Kathy
Paradowski owns part of a Buffalo strip club.
He said it wasn't the right thing to do, that
he didn't think the taxpayers money should be
spent to somebody who actually exploits
women. He told WLVL he found out about
it by doing some research on Google and
that he had other concerns about the agreement.
He said there was actually about ten different
points and what he really wanted was just
more time because he only got his copy of
the contract Tuesday. He said he found the
information just a few hours before the meeting
and did not have a chance to discuss it with anyone.
A heated exchange took place during a 20-minute
closed door session on the issue. Chapman said
he did not see why there was such a rush to
vote on it since the contract did not have to be
renewed till Ocotober. Alderman Jack Smith also
voted no. Mayor Mike Tucker said he already
knew of Paradowski's connection to the club.
He said he didn not see how it was relevant,
that they hired her to do a concert series and
not to bring a strip club in. He said she had a
track record in North Tonawanda with the concerts
for six years and it was very successful. He said
he did not see how one was relevant to the
other. The City will pay $8,800a week to rent the
stage for nine shows each Summer in 2011, 2012,
and 2013. Paradowski says she owns less than
20 per cent of the Colonie Lounge on Hertel
Avenue. She called herself a silent owner. The
Council also set a public hearing for February
16 on Chapman's proposal for term limits for the
Council and the Mayor.

SMOKES

The Governor hopes to begin collecting taxes
in July on cigarettes sold to non-Indians at
reservation stores. A Paterson aide said
yesterday new regulations would be released
soon..and it would start a six month comment
period and the State could start collecting them
as soon as July. Paterson's legal counsel,
Peter Kiernan, said they would continue talking
with the Senecas and others to try to reach
price equality arrangements whereby the cost
of a pack would be the same on and off the
reservation. He said Paterson will enforce the
law and is taking steps to do so. Seneca
Tribal Counselor JC Seneca said no negotiations
had taken place in his two meetings with
Paterson. He said they would be out of
business if the Governor and the Legislature had
their way. He said it would be devastating to their
economy and the economy of Western New York.
Seneca said the State needed to leave them alone
and should let them do their business and create
opportunities for their people.

BRODERICK RESIGNS

County Treasurer Dave Broderick will resign
his post at the end of the month. The 71 year
old said he was in ill health in a brief letter
to County Clerk Wayne Jagow. His deputy,
North Tonawanda Republican Leslie
Stolzenfels, will take his place until the
Governor appoints some to take Brodericks
position. Broderick's term would have run
out at the end of the year and he previously
said he would not run for another. The last
15 months have not been easy for Broderick.
He faced allegations he manipulated estates
he controlled as part of his job in such a way
as to enrich him and his wife.

OVER FOUR HUNDRED THOUSAND

The Niagara Falls Public Library has hired a
collection agency to go after almost $465,000
in unpaid fines. In an audit released Tuesday,
State Comptroller Ton DiNapoli said the library
used an inadequate accounting system that
did not give them a true idea of how much was
owed in unpaid fines.

NO CHARGES FILED IN SHOOTING IN THE FALLS

Falls police have yet to file charges against a man
who allegedly shot another man who broke into
a home at 541 25th Street around 5:30 pm yesterday.
Twenty-two year old Parrish Spencer Jr of 2271
Falls Street is in stable condition at ECMC. Detectives
said the gunman may have been defending himself
from Spencer. Spencer was apparently there to
confront his mothers boyfriend. Police say Spencer
broke into the home, kicked his mom to the floor,
and made his way to the second floor where the
boyfriend was on the phone calling 9-1-1 to report
the break-in. That's when the boyfriend allegedly
shot Spencer.

CATHOLIC CHARITIES

Buffalo Catholic Bishop Edward Kmiec joined
about 50 volunteers and clergy from seven
Lockport parishes last night at the Tuscarora
Club for a training workshop for Catholic
Charities volunteers. The charity's interim
director, Sister Mary McCarrick said this years
theme, "Whoever, Whenever, Wherever"
captures the essence of their mission to
serve anyone in need throughout the 8
county area. Kmiec encouraged the
volunteers to continue the good work of
the appeal in their parishes. He pointed to
the fact that they served more than 17,000
County residents last year through
multiple services. This year's goal is
$10.5-million, which is less than they
brought in last year when they failed
to meet their target. The official appeal
week is March 21-28.

THREE INJURED IN ACCIDENT

Three Falls residents were sent to ECMC following
a three car crash yesterday afternoon at the intersection
of Saunders Settlement and Miller Roads in Lewiston.
Police say a car driven by 17 year old Kyle Briggs of
Jagow Road rear ended another operated by 18 year
old Simone Cain of 18th Street. Cain's vehicle then
spun into a third car operated by 51 year old Megan
Babcock of Dogwood Place. Babcock was stopped
to make a turn onto Miller. A passenger in Cain's
vehicle, 19 year old Danielle Miller of South Avenue
in the Falls...was taken to ECMC by Mercy Flight with
non life threatening injuries. Cain and Babcock were
taken to the hospital by ambulance with minor injuries.
Briggs was cited for following too closely.

DRUGS

A Lockport couple was charged with possession
of a controlled substance at 2:30 am today after
police pulled them over on Gooding Street for
allegedly failing to signal a turn. They are 45 year
old Henry Dege and 44 year old Vicky Dege of
15 Price Street. Police said they had seen their
vehicle leaving a known drug location on two
seperate occasions. They say they found cocaine
on the passenger seat. In a similiar story, 31 year
old Angela Stranges of 1064 Fernwood Drive was
charged with possessing three valium pills at
5:15 pm yesterday after she was pulled over on
Pine Street for allegedly failing to signal a turn.
Officers said she was nervous and excited and
admitted she had just bought two hits of crack.
She said there was nothing in her car and gave
them permission to search. Police said they
found the valium in a prescription bottle containing
several different types of pills.

WHEATFIELD

A 39 year old Wheatfield woman was sentenced
to six months in jail and ten years probation
yesterday in County Court for having a four year
sexual relationship with a young boy. Kristine
Kornacki-Miller of Katherine Drive plead guilty
last October to third degree rape. The relationship
started in 2006 when the boy was 13. The boys
mother said her son was mentally and emotionally
damaged by the experience. She said in every
place and at every time she found an opportunity,
she raped her son.

CHAN GAILEY

As expected, the Bills yesterday named 58
year old Chan Gailey to be the team's
15th head coach...and the fifth in the last
ten years. Gailey was hired following
a two month search to replace Dick Jauron
who was let go in November. Gailey seems
to fit the profile that General Manager Buddy
Nix said he was looking for. He coached
the Cowboys for two seasons and he's held
a wide array of offense jobs.....he was the
offensive coordinator in Denver, Philadelphia,
and Miami. He spent six years at Georgia
Tech before becoming the offensive
coordinator in Kansas City in 2008.

THE GOVERNOR'S BUDGET ADDRESS

The Governor introduced a $134-billion state
spending plan Tuesday that would hike the tax
on cigarettes by another dollar, assess a 16 per
cent tax on sugary soft drinks, and make major
cuts to education and health care. He also
proposed going after native American retailers
who sell untaxed cigarettes to non Indians. The
spending plan contains $5.5-billion in cuts and
a billion dollars in tax hikes. It would cut aid to
schools by $1.1-billion, freeze the pay for non
union state workers, allow grocery stores to
pay a franchise fee to sell wine, and limit the
growth of Medicaid spending to $51.5-billion,
an increase of 1.8 per cent. Paterson would also
increase the operating hours for Quick Draw
and video lottery terminals. He said it was all
needed because they could no longer borrow
because it would increase their debt service,
and there were no fiscal gimmicks left, and
they had already raided all their accounts.
Assembly Speaker Sheldon Silver said the
cuts went too far and State Senator George
Maziarz did not like what he heard, he said he
could not vote for the package as it currently
stands. Just a few hours after he spoke,
Paterson and the Legislature failed to agree
on a plan to comply with federal regulations
that would make the state eligible for $700-million
in education funding under the Race to The
Top program.

TUCKER'S STATE OF THE CITY ADDRESS

Lockport Mayor Mike Tucker reported Tuesday
the "state of the city" remains strong but he
warned steep challenges lie ahead. He said
initial projections from Albany indicate the
governor plans to withhold ten percent of the
state aid and the cost to local municipalities to
the employee pension fund will increase dramatically
in 2011. He said unless state leaders recognize
they cannot shift the burden of unfunded mandates
to local government, it will have a substantial
impact on operations. He said they should be
ready to trim their budget, promote attrition, and
begin changing the way services are provided.
Tucker said his Administration recognized the
impending situation two years ago. He said they
secured substantial concessions during negotiations
with union workers. He said the highlights included
the privitization of garbage service, the real ability
to share services with other municipalities, and
embracing central dispatch. Tucker said the time
had come to revise and modernize the city
charter, the master plan, and zoning and planning
ordinances. He said he would reinstitute the
Citizens Advisory Board to begin the process of
revising the charter. The Mayor also said he wants
to enhance the City's website so citizens can
report garbage, small pothole, and tree trimming
issues. He said it was time to allow the payment
of taxes and water bills on-line and to take credit
card payments. About 40 people listened to the
speech during a noon meeting of the Rotary at
the Lockport Town & Country Club.

COUNTY LEGISLATURE

County Legislature Chairman Bill Ross last
night promised a group protesting the movement
of remarks by citizens for the good of the county..
to the end of the meeting..that they would monitor
the new system as the year progresses. During the
meeting, NCCC President James Klyczek updated
lawmakers on the Culinary Arts Institute project.
He said the school does not need any more money
from the County than the $1.5-million the Legislature
pledged two years ago. All the parties involved are
expected to sign a memorandum of understanding
soon. It will start a 120-day period where Klyczek
will decide if the Institute can be opened for
$13.2-million and for him to come up with more money
if it's needed. The City of Niagara Falls also has to
come up with an estimate on how much it will cost
to make repairs to the roof of the Rainbow Mall, it's
skylights, and the nearby parking ramp. The Legislature
also voted 13-5 to change the law on filling vacant
seats in between elections. It allows them to appoint
whoever they want, rather than having to chose a
member of the same political party as the former
lawmaker. They passed a resolution to send a
letter to Judge Richard Arcara urging him to order
the Niagara Falls Bridge Commission to reveal the
terms of the departure of former Chairman Tom
Garlock.

MAN FOUND SHOT DEATH IN THE FALLS

Falls police are searching for a suspect after a
24 year old man was found shot to death Monday
night in his apartment at the corner of 18th &
Ontario. Thomas Howard was found bleeding
lying on his kitchen floor. Detective Captain Ernest
Palmer said there was lumber lying on top of him
and some power tools were near his body. Medical
examiners said he died from a gunshot wound to the
chest and bled out through his lungs. Howard's body was
discovered by a friend who went to look for him after
he failed to answer cell phone calls from his girlfriend.
Palmer said a robbery attempt might have led to
Howard's murder but he would not say what might
have been taken from the apartment.

LIBRARY REPORT ISSUED IN THE FALLS

State Comptroller Tom DiNapoli issued a
report Tuesday on the operation of the Niagara
Falls Library system. He said it suffered from
a lack of committment by the trustees and questionable
financial oversight. He issued ten reccomendations for
improvement.

CEKJA

Channel 4 meterologist Mike Cejka was not in
Town of Lockport court last night, but his
attorney accepted a reduced charge on
allegations he failed to stop at a stop sign and
did not signal a turn. The charge was turned
into a parking ticket and he was fined $290.
As for the trespassing charges against the
50 year old, the judge ruled they would be dismissed
July 19 if Cejka stays away from a home on Old
Beattie Road where he had been accused of
trespassing on on December 14.

GUN STOLEN IN ROYALTON

A $500 handgun was taken during a burglary
yesterday from a home at 7643 Akron Road in
Royalton. A 63 year old said he left the doors
unlocked when he left for about an hour on
two occasions during the day. The gun is a
Smith & Wesson 357 six shooter model 686.

HOUSE FIRE

A two story home at 7033 Northview Drive in the
Town of Lockport suffered extensive damage
around 11 last night after a gas dryer caught fire.
Forty-five year old Tracy Bugna said she was
on the second floor when she smelled smoke
and discovered the blaze in the laundry room.
She tried to put it out with a fire extenguisher
but it was too far along so the family evacuated
with their pets and called 911. They are being
helped by the Red Cross. No damage estimate
was provided. The South Lockport Fire
Company, Rapids, and Terrys Corners were
on the scene.

POLL RESULTS

A new Siena Research poll released Monday
shows the governor's favorability rating
has risen for the third straight month. He's
now at a point where 38 per cent of New
Yorkers have a favorable view and 52 per
cent unfavorable. It's still in thenegative
category but the numbers were 27 per
cent positive, 61% in October. Executive
Director Steve Greenburg says the bad news
is that by a 3 to 1 margin voters still have an
unfavorable view of his job performance.
Only 21 per cent were ready to elect him to
a full four year term....compared to 60 per
cent who would prefer someone else. Paterson
would also lose badly to Andrew Cuomo in
a democratic primary and would have a hard
time beating the two likely Republican
opponents, Rick Lazio and Chris Collins.
Greenburg also says for the first time, more
voters now have an unfavorable view of
Senator Kirsten Gillibrand. Sixty one
percent of the respondents thought the state
was headed in the wrong direction. The survey
of 806 likely voters was taken from January
10-14.

SPECIAL SESSION

In a special session last night, lawmakers in
Albany refused to act on a bill the Governor
said was needed for the State to have a chance
at $700-million in federal school aid. Republican
senators were ignored by the Democratic majority
when they tried to bring Paterson's bill to a vote.
They said the result will likely be the loss of the
federal aid, higher school taxes, and a net cut
of hundreds of millions of dollars in statewide
school funding. The Assembly and Senate could
pass their own alternative bill this morning but
Paterson says it would hurt the State's chances of
being accepted in the Race To The Top program.
It would raise the number of charter schools from
200 to 400 but the feds want more reforms for a
state to be accepted. Paterson is slated to
unveil his executive budget at 11 am today.

STAINED GLASS WINDOW STOLEN

A local developer told Falls police yesterday a
$10,000 stained glass window was stolen from a
vacant building he owns in the 700 block of
Division Avenue. Richard Hastings of Youngstown
said it was taken sometime since last Thursday.
He suspects they entered the building through a
basement window which he found unlocked.
He said $200 worth of antique doorknobs were
also removed from the second and third floors.

CAR BREAK-IN'S NEAR CASINO

Several thousand dollars worth of electronics
and other items were reported stolen around
3am Monday from two vehicles parked near the
Seneca Niagara Casino. Four tourists with
California and New York addresses said the
passenger windows of a 2007 Mercedes had
been smashed. A global positioning system,
five cell phones, designer bags and shoes, and
a computer were among the items taken. A Buffalo
man said a passenger window was broken and
a door was forced open on his 2003 Chevy Malibu
that was parked in another lot near the casino.
He said a GPS system and electronic cords
were taken.

SEIZURE

A 19 year old Lockport man was advised not to
drive yesterday after he apparently suffered an
epileptis seizure while behind the wheel. The man
was found unresponsive after deputies got a call
around 9:30am that his green Camaro was stopped
in the left south bound lane of South Transit near the
drive in. Deputies said the man's hands and arms
were clenched by his side, his eyes were closed,
he was drooling, and his legs were flexed on the
brakes. The man eventually opened his eyes
but could not communicate. He was taken to ENH-
Lockport but refused medical treatment. The ER
doctor said the man should not drive for at least
six months and deputies said they would send
that reccomendation to the DMV along with a police
agency request for a driver review.

COPPER STOLEN

An estimated $2,000 worth of copper pipe were
reported stolen yesterday from an apartment
building at 5562 Davison Road. The owner of
MLD Plumbing of Orchard Park said his company
was working there and the pipe was on the floor
awaiting installation. The Sheriff's Department
says it appeared two suspects entered the
building through two unlocked windows. There
were tracks in the snow leading to the Lincoln
Place Apartments but they stopped at the parking
lot. The theft happened between last Friday and
8am Monday.

BURGLARY/CRIMINAL CONTEMPT

A 39 year old Lockport man was arrested by the
State Police over the weekend after he allegedly
entered the home of a Lockport woman while
she slept. Todd Dwyer of Tonawanda Creek
Road was pushed out of the house by the
woman after she woke up. He was charged
with burglary and criminal contempt for

FORMER UNION SUN EDITOR PASSES AWAY

The former managing editor of the Union Sun &
Journal passed away in Ohio over the weekend.

from 1983 thru 1999. Details of his death were not
released by the family. Kane was a native of Lockport.
He attended DeSales High School and graduated from

Tonawanda News before accepting the position
in Lockport. Kane left the Union Sun after it was
sold to Community Newspapers. He was very active
in the community serving on the Board of Managers
at Lockport Memorial Hospital. He started the
annual fundraiser for the Sister Mary Loretto Soup
Kitchen and also served on the city's Civil Service
Commission for 17 years.

SPECIAL SESSION/PATERSON ALLEGATION

The Governor has called a special session of
the Legislature for 8pm tonight to negoiate changes
to a bill being proposed by the Legislature that would
limit the number of charter schools in the State to 400.
Paterson says Education Secretary Arne Duncan told
him the State must eliminate the cap or raise it to new
fewer than 454 to qualify for up to $700-million in
federal aid under the "Race To The Top" program.
He said lawmakers imposed it at the urging of the
Teachers Union and other school lobbyists. Charter
schools compete with traditional public schools for
funding. The cap is currently 200. Meantime, the
Governor says there's nothing to it, but the New
York Post reported Sunday Paterson was seen
nuzzling, neck kissing, and cooing like a smitten
schoolboy with a young woman...who was not his
wife, in a New Jersey steakhouse Saturday afternoon.
A lawyer sitting two tables away told the paper he
was right on her neck nudging back and forth.
A Paterson spokesman said the woman was just
a friend and any insinuation of improper
behavior was absolutely false. Paterson told the
paper himself that she works with him.

EARTHQUAKE HELP

The Outreach Center at Lockport's Saint
John The Baptist church has pledged
$10,000 to help the victims of the earthquake
in Haiti. Director Jim Haid says the money will
be given to Catholic Relief Services. He's hoping
members of other churches and local
businessmen will help them meet the pledge.
Send your donation to Saint John's Outreach
Center at 160 Chestnut and mark it "Haiti
Relief." Meantime, two C-130's left the Falls
Air Base Saturday to carry supplies to the
capitol of Port au Prince. They stopped at
Pope Air Force Base in North Carolina to
pick up supplies. The Air Force says they'll be
shuttling back and forth for five days between
Homestead Air Force Base in Florida and Haiti.

SMOKING POT IN HIGH SCHOOL LOT

AN 18 year old Lockport man was charged with
possession of marijuana after city police allegedly
found a bong in his car while he and a girl
were parked in the lot at Lockport High School.
It happened just after 12:30 am Sunday.
Brandyn Archie of 774 Walnut also told
police he had pot inside a Skoal can. The
female passenger was turned over to her
father.

can call for information at 434-3071.

JUST ONE HEADLIGHT

A 20 year old Lockport man is facing drug charges
after he was pulled over just before 1am today on
Lake Avenue for operating with just one headlight.
Deputies said they found an open ended pen stem
with a white powdery substance visible on both
ends in the vehicle operated by Cory Lederhouse
of 278 Chapel. He told them the substance was what
was left of a hydrocodone pill. He said he and his
two friends were on their way home from a party in
Lancaster. Lederhouse was given an appearance
ticket for January 28 in Town of Lockport Court and
also charged with an equipment violation.

SIXTEEN YEAR OLD CHARGED WITH VIOLATING LEANDRA'S LAW

A 16 year old Middleport boy was charged by
State Police last Thursday with a felony. Curtis
Stipp of Countyline Road is accused of violating
Leandra's Law for having a 15 year old in his car
while he was allegedly operating it while under the
influence of drugs. He was stopped on Route 31 in
