CESCON FREE ON BAIL

The teenager accused of being the driver of the
vehicle that struck and killed 17 year old Adam
Mottron on Tuesday is free on $25,000 bail. Anthony
Cescon of 141 Ohio Street was arrested Wednesday and
charged with leaving the scene of the Porter Street
incident. Detective Captain Rick Podgers says
Cescon admits that he and another boy met Mottron
about getting some marijuana but they did not plan
to pay for it. Mottorn was allegedly run down as they
attempted to leave. Podgers says a 40 year old
neighbor saw everything.

BRODERICK TO RETIRE, ANDFREWS TO RUN

County Treasurer Dave Broderick announced
Thursday he will not run for another term
next year. His announcement was immediately
followed by another by lawmaker Kyle Andrews.
The 29 year old says he wants the job. He has
served four terms in the County Legilsature and
says he has the right educational background and
experience in leadership. He's an Army Reserve
Captain. Andrews said the Treasurers Office needs
to become an open resource to county residents
and that all financial transactions should be posted
online so residents can review the county's
checkbook in the same way they view their
personal accounts. He graduated Summa Cum
Laude from Niagara University with a bachelors
degree in political science. He's on the Board of
Directors for Opportunities Unlimited and is also
the President of the Wilson Historical Society. He's
engaged to be married later this year. Andrews also
announced he would be leaving the Harris Beach
law firm at the end of the year. He's been a Public
Finance and Economic Development attorney. He
said he plans on begininng a private practice while
he focuses on an agressive door to door campaign
for Treasurer. As for Broderick, his current term
ends at the end of 2010. He's held the office for
38 years.

FIRE PREVENTION

Niagara Falls Fire Chief Bill MacKay announced
a two phase effort Thursday to cut down on all
accidental fires in the city. Phase One is called
"Don't Give Fire A Home" and involves a door
to door campaign. He said they want to make
sure that residents use the information they
provide and that a battery they give them actually
makes it way into the smoke detector. He said they're
going to take a much more active role working
with homeowners in a more one on one scenario.
MacKay said 40% of all house fires in the nation
this year have been cooking related, and that
in the Falls, they responded more than 160 times
to fires related to unattended cooking. There were
no working smoke detectors at 63 per cent of all
fires in the City. Phase two involves the
establishment of post fire "safety response
teams." Firefighters will blitz neighborhoods
following an accidental blaze and see if they
can find, and correct, similiar problems that may
have the caused the origional fire and exist in
other homes. He also asked block clubs to
expand their mission and help the effort. Niagara
University will also be involved. A mother and
her daughter were killed last Saturday in a house
fire at 716 Monteagle.

BUDGET REVIEW STARTS IN THE FALLS

Lawmakers in the Falls yesterday started their
review of the Mayor's proposed budget. They
decided to do away with the position of
Economic Development Coordinator and to
cut the salary of City Administrator Donna
Owens by $40,000. The Mayor can veto the
changes but the Council can override it later
in the process. The Council also did away
with proposed raises for 21 others and cut
over $71,000 in travel and training expenses.
The eliminated raises included a $3,000 hike
for Business Development Director Fran Iusi
and an additional $1496 each for the
secretaries of the Mayor, the City Administrator,
and the City Council.

HELP FOR DAIRY FARMERS

Senator Chuck Schumer wants the Agriculture
Department to provide help to the dairy
industry before the end of the year. He says he
wrote Agriculture Secretary Tom Vilsack and
asked him to begin the distribution of the
$290-million Congress appropriated. Schumer
told him the government needs to rush the
money to New York's dairy farmers to prevent
more of them from going out of business. The
bill was signed into law October 21. Schumer
is also renewing his push to have the money
distributed similiar to the MILC program. Under
his plan, farmers would see the same amount
of money as they would if the reimbursement
rate was temporarily raised to 90 per cent.

RALPH TALKS TO THE AP

Bills owner Ralph Wilson told the Associated
Press yesterday anybody that says he's cheap
is looking down the wrong side of the road. He
said he's prepared to revamp his entire football
operation at the end of the season. He acknowleged
they have a lot of work to do. He said every
position would be reviewed. He said it's not
about money, it's about winning. He dismissed
reports the team is interested in former Denver
coach Mike Shanahan. The interview coming
as Buffalo gets ready to face Jacksonville
Sunday with new head coach Perry Fewell.

FLIGHT OF STAIRS

A Lockport man who allegedly pushed a
North Tonawanda woman down a flight of
stairs yesterday ended up falling down the
same staircase. Police said they were called
to 288 Washburn around 5:45pm for a
report of a fight. The woman told them she
was helping her boyfriend move some stuff
out of his second floor apartment when 60
year old Peter Ackroyd came out into the
common hallway and started mumbling
something to her. She says he then pushed
her down the flight of stairs for no reason. Her
boyfriend attempted to get Ackroyd back into
his own apartment, but Ackroyd tried to push
him down the same flight of stairs. He missed
the boyfriend and fell down the stairs himself.
Ackroyd was charged with third degree assault
ad with initially giving police a false name. The
woman complained of lower back pain and
Ackroyd was treated for a cut on the lip.

UNLOCKED VEHICLES ENTERED ON TOWNLINE ROAD

The Sheriff's department is investigating reports
received yesterday morning that three unlocked
vehicles were entered overnight on Townline
road. A 60 year old Pendleton woman said nothing
was taken from her 2005 Buick, but a 27 year old
said ten C-D's and $24 in cash were missing from
his car. A Garmin GPS unit and about ten dollars
in change was taken from the third car.

GUILIANI

Aides to former New York City Mayor Rudy
Guiliani are denying published reports
yesterday that he's decided not to run for
Governor next year. The New York Times says
he's eyeing a run for the Senate against Kirsten
Gillibrand. If that's true, it would open the field
for Erie County Exective Chris Collins and
former Congressman Rick Lazio to enter the
Republican race for governor.

FALLS SCHOOL BOARD

The Niagara Falls School Board last night
filled the last two vacancies left from
September's firing spree. An English
teacher was appointed for the High School
and a computer applications specialist
was hired. The English teacher already
worked for the district and was given the
job based on seniority...but Human Resources
Director Phil Mohr said it was a contractural
substitution and would last through the
end of the year. The other job went to a
Grand Island resident who has six months
to move into the District. The seven people
that were fired in September were let go
because they did not.

LOCKPORT COMMON COUNCIL

Lockport Mayor Mike Tucker told the Common
Council Wednesday night a Syracuse not-for-
profit is planning to invest $8.5-million in the
City. Housing Visions Unlimited was lured to
Lockport by newly elected alderman Jack Smith
and his United Neighborhood Block Club. He said
they have a purchase agreement with owners for
several properties on Genesee Street and some
on Locust. They will be rehabbing some of the
architecurally significant houses, tear down some
others, and build new ones on vacant lots. He said
they would create low income housing and they
have a very intense screening process for
potential tenants. About 15 properties are
involved. The site plans will be presented to the
Plannning Board December 21 and the Zoning
Board the following night. Tucker also announced
that the City has come to terms with two if it's
unions. The deals with AFSCME and the department
head union are backdated to January 1 of this year.
He said AFSCME had agreed to let the City look
at privatizing the way they pick up everyday garbage
and that it might make recycling more affordable
and possible. The deal also gives the City the
option of not filling 11 jobs when current workers
retire or leave. The agreement with the department
heads gives the City the option of not hiring a
full time assessor.

LOCKPORT HIGH SCHOOL STUDENT CHARGED

Lockport police charged a 17 year old
boy with a felony yesterday for allegedly
leaving the scene of an accident where a
person dies. Detective Captain Rick Podgers
said 17 year old Anthony Cescon of Ohio
Street hit 17 year old Adam Mottorn of
Porter Street about 4pm Tuesday. He later
died at ECMC. Podgers said the accident
appeared to be intentional and involved a
dispute over marijuana sales. A second
suspect has cooperated with police and has
not yet been charged. Podgers said he
expected the case will be presented to a
grand jury. Mottorn lived just a couple
of doors away from where the incident
happened. The two boys say it was an
accident but witnesses told police Cescon
intentionally ran into Mottorn. Cescon is
being held on $25,000 bail after pleading not
guilty at his arraignment. A pre-trial hearing
will be held December 2. High School
Principal Frank Movalli said grief counselors
and clergy where at the school yesterday.
A makeshift memorial was erected at the site
of the crash and an unsteady stream of
mourners held a vigil there last night.

FALLS BURGLARY SUSPECT

A 38 year old Sanborn man is being held without
bail after he was arraigned in City Court in
Niagara Falls yesterday on charges he was
involved in a string of burglaries in DeVeaux.
Jacques Meness of Chew Road is charged with
five counts of burglary, two of grand larceny,
two of petit larceny, and two more of criminal
mischief. The burglaries took place between
October 23 and November 9 on Lewiston Road,
Whirlpool Street, Clifton Avenue and Chestnut
Avenue. Meness was caught November 9 in the
2600 block of Whirlpool as he was allegedly
breaking into a home and business in the 2600
block of Main Street.

SWINE FLU DEATH

A memorial service was held today for a 10th
grader at Niagara Wheatfield who died Monday
night from complications linked to the H1 N1
flu. Fifteen year old Paul Nichiporuk did not
have an underlying medical condition. He was
taken to Buffalo's Womens & Childrens Hospital
by his family October 30 after suffering a fever of
102 or 103 degrees. He was there for 16 days
before his family decided to take him off life
support Monday. They moved to Wheatfield
about seven years ago from the Sweet Home
School District. Paul was the youngest of five
children in the family. His sister told the Buffalo
News his initial test for H1N1 came back negative
and it was not until the 11th day of his illness they
found out he had the Swine Flu.

LEWISTON BUDGET OK'D

Lawmakers in the Town of Lewiston last
night o-k'd a $14.4-million spending plan
for next year. The budget includes a 3 per cent
raise for all Town workers plus an increase
for new Supervisor Steve Reiter. There is
also a provision to pay off the special district
tax for garbage collection and to lower the
water tax by an additional 3-cents per
thousand dollars valuation. Current Supervisor
Fred Newlin said it would lower taxes on a home
assessed at $100,000 by $65.

GUILTY PLEA

A North Tonawanda girl plead guilty in County
Court Wednesday to criminally negligent
homicide in the death of her boyfriend. Ashley
Sullivan admitted she was driving drunk May 31
when she crashed her car into a brick pillar in
front of the Deerwood Golf Course on Sweeney
Street. Twenty year old Alex Rozicki of
Niagara Falls was killed in the accident. Sullivan
will be sentenced January 27. She could get
probation or as much as four years in prison.
The Rizicki family plans to file a wrongful death
suit.

H 1 N 1

The County Health Department saying today
testing has confirmed that the recent death
of a Niagara Wheatfield 10th grader was linked
to the H1 N1 flu. The teen did not have an
underlying medical condition but died from
complications related to the virus.
Spokesperson Elaine Roman said they
would not be saying too much more out of
consideration for the family. She repeated the
message that County Health Director Dan
Stapleton gave to county lawmakers last
night. There is a shortage of the vaccine.
It has started to come in and they are talking
with school superintendents about holding
clinics. Parents with high risk children are
being told to call 278-1903 so they can
receive a shot.

NEW HEAD COACH


The Bills have a new head coach. Owner Ralph
Wilson fired Dick Jauron yesterday and replaced
him with defensive co-ordinator Perry Fewell.
Fewell's been with the team for 3 1/2 years,
he came to Buffalo with Jauron from the Bears.
He's 47 and is in his 12th year with the NFL as a
coach. Jauron was the 14th head coach in the
history of the franchise. The team had three
straight 7 & 9 seasons under his tenure and
is 3 & 6 at this point of the season. Fewell
said he thought the team would be focused
when they play Jacksonville Sunday.

MISSING GIRL FOUND

A 12 year old girl who had been reported
missing yesterday from Wyndham Lawn was
found by Lockport police just after 2am today.
The youngster was walking down Genesee Street
and officers spotted her while on routine patrol.
She gave them a fake name at first, she was
turned over to the Sheriff's Department and they
returned her to Wyndham Lawn.

FATAL FIRE "ACCIDENTAL"

Fire investigators in the Falls said Tuesday a
blaqze that killed a mother and her daughter
at 716 Monteagle last Saturday was accidental.
Fire Chief Bill MacKay said it started in the
kitchen and was caused by unattended cooking.
He said there was no working smoke detector in
the two story home , that they were either missing
batteries or just didn't work. MacKay said there
have been six accidental fires within 50 yards of
the home within the last two years and that most
of them happened on Friday nights and Saturday
mornings. He said they involve issues of
behavior and he would address them at a news
conference tomorrow morning at 11 at the
intersection of McKoon and Monteagle.

TASERED MAN RECEIVES SENTENCE

The Falls man who was tasered to get a DNA
sample was sentenced to 45 years in prison
Tuesday by County Judge Sara Sheldon
Sperrazza. Attornies for 21 year old Ryan
Smith filed an appeal later in the day. The
Appelate Division of State Supreme Court
will eventually decide whether it was o-k for
the prosecution to use the sample and
whether it was legal for it to be taken without
the knowledge of his defense team. Smith was
found guilty of two home invasions, a shooting,
and an armed robbery.

NEW POLICE SUBSTATION IN THE FALLS

A ribbon cutting was held in the Falls Tuesday for
a new police substation at the corner of 19th
and Ferry. It's in a new federal "weed and seed"
area. Officers say they will have a zero tolerance
policy on criminal activity especially quality of
life crimes. Police Chief John Chella said they
would win back the neighborhood. He said
anyone who thinks they're joking should test
them. He guaranteed they would be a guest at the
new city jail.

STARPOINT

The County Health Department is making plans
to hold it's first H-1 N-1 clinic Saturday at
Starpoint. Nurses, doctors, and pharmacists
will vaccinate over 2500 students and others
between 9am and 9pm. The shots will be
given to the students, pregnant women, and
household members with infants less than six
months old. The District has pre-registered
students and family members for specific time
slots in an effort to control traffic and parking.
Residents of the district who have not
pre-registered but who fall into the target
groups should show up between 3 & 8:30pm.
Several Superintendents and representatives
from other districts will be there to watch. The
Health Department is talking with them about
scheduling clinics in their districts.

EASTERN NIAGARA UNITED WAY

The Eastern Niagara United Way is slated to
wrap up it's yearly campaign tomorrow but
Co-Chair Dave Kinyon says they are about
$80,000 shy of their $750,000 goal. He said
they could still reach their target, noting that
the United Way of Niagara was short about the
same amount last week and managed to
execeed their goal. The campaign's Victory
Luncheon is set for noon Wednesday at Cornell
Cooperative Extension. It's open to the
public. Tickets are $15 and reservations can be
made by calling 434-1190. You can also call
the same number to make last minute pledges.

FALLS COUNCIL MEETING

Lawmakers in the Falls agreed last night to
overhaul the city's anti-discrimination policies.
The decision coming after the State Attorney
General's office concluded a 16 month
investigation. The department's Civil Rights
Bureau Chief Alphonso David told the council
the agreement requires the City to take all
measures necessary to address any recrimination or
retaliation against employees who file a claim
of discrimination. The City must hire an Equal
Employment Opportunity Officer to oversee
compliance with the law and to promote
equal opportunity. The City must create and
implement a plan to conduct targeted outreach
education and recruitment to ensure equal
employment opportunities, and put together
a revised discrimination and harassment
policy to include stricter reporting requirements,
targeted timelines for addressing complaints,
and oversight and review of complaints by the
EEOC officer. The officer must also conduct an
independant review of all discrimination complaints
filed with the City as of January 1, 2008 and determine
if they have merit and if so, make reccomendations
for appropriate relief. The action came on the same
night the Council o-k'd a $240,000 payment to the
Niagara Falls Six, but Mayor Paul Dyster called it
a coincidence. He said they might have to hire some
additional staff to comply with the deal, at least at
the beginning.

CHARITY REPORT

State Attorney General Andy Cuomo released
his annual report Monday on fundraising
activities conducted by charities. It said that,
on average, just 39 1/2 cents of every dollar
raised by professional telemarketers actually
ever makes it's way to the charity. The report
says they raised about $205-million on behalf
of 444 charities in 2008. The fundraisers took
60 per cent. The South Lockport Fire Company
was listed in the report. Spotlight Music
Productions raised almost $47,000 for them
last year but the fire company only received
about $12,000. Cuomo said $1.7-million was
raised by telemarketers in the eight Western
New York counties for numerous police and
firefighter groups. The organizations only
received 29 percent of the money raised.

SCHUMER VISITS THE FALLS

Senator Chuck Schumer said Monday he has
arranged a meeting between himself, Mayor
Paul Dyster, and New York City real estate
developer Richard Milstein. The three will talk
about the nearly 70 acres of vacant properties
in the City controlled by Niagara Falls
Redevelopment. Schumer said Milstein did
not promise to do anything, but said he would
listen, and maybe they could come up with
something that would be very good for the City.
Schumer was in the Falls to announce his
committment to find the remaining $2.5-million
needed to move the N-CCC Culinary Arts
Institute to the Rainbow Mall.

NEW VILLAGE MAYOR

The Deputy Mayor was appointed the Mayor last
night in the Village of Lewiston. William Geiban
replaces Richard Soluri who resigned last month.
The Chairman of the Planning Board was appointed
to fill Geiben's seat on the Village Board. Geiben is
a retired Lew-Port social studies teacher. He calls
Soluri his mentor. Geiben served six years on the
Town Board before serving on the Village Board.

KICKED IN THE FACE WHILE ON BUS

A student at Starpoint was taken to ENH-Lockport
Monday afternoon after he was kicked in the face
while on the school bus. Officials said the nose
of Christopher Bogar-Lopez was bleeding
heavily. He told Sheriff's deputies it might have
been an accident, that it happened as he and two
other boys were messing around with a seat. One
of them said Bogar-Lopez's hand was near his
foot and he attempted to kick it away and hit his
face instead. A bus aide tried to stop the bleeding
with paper towels. The youngster was taken to the
hospital by his mother who said she would be
contacting Starpoint about the incident.

TRAFFIC STOP LEADS TO ASSAULT CHARGES

Lockport police got more than they expected
when they pulled a 31 year old man over for a
traffic infraction around 2:30am Monday. The
man pulled into a driveway at 237 North Transit
and as police were talking with him, a woman
came out of the house and told police he had
just beaten her up. She had multiple cuts and
marks on her face and neck. Shannon
Richardson was charged with assault,
improper lane use, obstructing an intersection,
and an equipment violation.

COCOA BUTTER

A 23 year old Lockport man was arrested just after
1:30 this morning at 266 Ontario. Jeremy Branch
of 102 Grand, Upper, allegedly violated an order
of protection and threw a bottle of cocoa butter
on the victim's vehicle.

PEKIN FIRE COMPANY

The Pekin Fire Company is missing a blue 1994
Dodge Caravan. The company says the
unregistered vehicle was stolen from the back
parking lot of their hall on Upper Mountain Road
sometime between last Thursday and 3am Sunday.
It's only worth $200.

LICENSE PLATES

The Governor said this morning he will do away
with plans to issue new license plates if lawmakers
come up with another way to raise the revenue or
cut $129-million from the budget. He said he had
not heard a proposal from anybody as to how they
would do so. He added he would be exploring some
ideas of his own in the next few days. He said it would
be better if they all worked together. Assembly Speaker
Sheldon Silver and Minority Leader Brian Kolb also
pronounced the plan dead Sunday. They promised to
work with Paterson to do so. The annoucements
coming as County Clerks from around the State
went to Albany today to present petitions against the
re-issuance to the Governor. Niagara County Deputy
Clerk Wendy Roberson said Friday they had collected
more than 3,000 signatures locally.

LEWISTON PORTER SENIOR KILLED IN ACCIDENT

A 17 year old Senior at Lew Port High School
was killed last night in a one vehicle crash on
Lewiston Road. Jonathon Miller was on his way
to Niagara University to work out in the gym. His
SUV jumped a curb and struck a tree about 200
yards South of Irving Drive. Police said he was
wearing a seat belt. The accident happened
around 5:50 pm. An autopsy is scheduled for
today.

SAVING MONEY ON ENERGY BILLS

Representatives from National Fuel will
tell you how to save money on your home
energy bills tonight. They'll join Assemblywoman
Francine Del Monte at a forum at the John Duke
Senior Center in the Falls. It begins at 6.

TOWN OF LOCKPORT HISTORICAL SOCIETY

Rosemary Sansone will talk about the history of
the Olcott Carousel at tonight's meeting of the
Town of Lockport Historical Society. Nominations
will also be taken for the upcoming election in
December. Tonights meeting will be in a new
location at Town Hall. It starts at 7:30.

DOWNTOWN MELTDOWN

Papa Leo's owner Gary Chpman was announced
the winner Saturday of Lockport's "Downtown
Meltdown." He lost 39 pounds and won the
competition for the United Way. Parker Greenman
lost 31, Anthony Molinaro 30, Mayor MikeTucker
shed 29, and Michael Molinaro lost 9, for a total
of 138 pounds. Lockport Athletic & Fitness Club
owner Amer Abdallah donated ten dollars for every
pound lost to the United Way. He presented the
participants with humorus awards prior to the
final weigh-in. Chapman was presented with the
True Democrat award for besting Tucker. The
Mayor was give the Jones Award....because
everyone was trying to keep up with him during
the competiiton. Trainer Gina Nowak was
presented with the Don King award for organizing
the event. She was given a medicine ball signed
by all the participants and a $500 package from
Salvatore's Italian Gardens. The competition started
October 5. Saturdays finale also featured an
auction for the United Way.

SOUTH JUNIOR PLAYGROUND

Falls Mayor Paul Dyster and members of NOAH
celebrated the beginning of construction of the
South Junior playground with an event at 9am
today. The future playground at the corner of
Portage and Walnut is meant to replace another
that was removed over two years ago.

UNITED WAY OF NIAGARA

Last minute donations Friday boosted the totals
for the United Way of Niagara. The campaign
said a total of $871,464 had been pledged, about
$7,000 over the goal of $863,954. They celebrated
the results at a luncheon Friday at the Crowne
Plaza.

CANAL CLOSES FOR SEASON

The State Canal System closed for the season at
5pm Sunday. Direrector Carmella Mantello said it was
a good year, noting traffic there was an increase in
traffic and more events and festivals were held than
ever before. During the Winter, workers will be busy
repairing buoys and other equipment retrieved from
the waterway in the Fall. There are also 57 locks and
16 lift bridges that need repairs. Some of the
equipment is 100 years old.

TRAFFIC STOP/DRUGS

Two teens are facing drug charges after Lockport
police pulled their car over just after 2am Sunday
for failing to signal a turn. Police said they could
smell the odor of marijauna coming from the
vehicle. The driver, 19 year old Brittany Christian
of 5978 East Main in Olcott gave them permission
to searcg. Police say they found a bag of pot in
her purse and a cut off straw with white residue
inside. She allegedly told them she used it to
snort crushed up pills. The passenger, 17 year old
Duchess Horton of 285 Petit in Wilson , handed over
half smoked marijuana cigarettes she had stuffed
in her bra. Police said they also found a small
amount in her purse as well.

MENACING

A Lockport man was being held on $500
bail at last report following an incident with
a knife late Saturday at a party at 5798 Sweetwood
Drive. Edward Webber was later arrested at
13 William Street. He is charged with menacing.

PURSE STOLEN DURING FILL-UP

A 23 year old Lockport woman had her purse
stolen from her car around 9:15 last night as
she was filling up at Smokin Joe's on Route 31.
She told deputies she had left her pink playboy
bunny purse inside her unlocked car while she
went inside to pay. She noticed it was missing
when she got home. It contained three
prescriptions, her wallet, and drivers license.
